What About Future Medical Bills and Doctor Visits After An Settlement?

Will the insurance company pay for my medical bills if my neck or back starts to hurt in the future? As a Salt Lake City Personal Injury Attorney I am often asked this question. Many times the person on the phone accepted a quick settlement after the accident and then started experiencing medical problems later.

When a case settles after an accident, the insurance company requires that the injured party sign a "Release" before providing a settlement check. This release specifically indicates that the injured party fully settles the claim and that no future payments or claims can be made against their driver. In other words, you only get one bodily injury settlement check from the insurance company! Your future medical bills will be your responsibility.

Before accepting an offer or signing a release provided by the insurance company, educate yourself. Talk to a personal injury attorney or at least get a free copy of Mr. Christensen's Utah Accident Book at www.UtahAccidentBook.com. An experienced accident lawyer will meet with your doctors and document what medical care you will need in the future and how much it will costs. Once this information is obtained, a full settlement can be reached with the insurance company.

Who Can Make A Wrongful Death Claim In Utah?

A Utah Wrongful Death claim arises when someone is killed in an accident due to the negligence of fault of another person.

In Utah a wrongful death case can be brought by the legal heirs of the person whom died as a result of the Utah accident. Only one single claim can be made on behalf of all heirs, but each of the heirs are entitled to a settlement. It is extremely beneficial to a Salt Lake City personal injury attorney specializing in fatal accident claims to ensure that the case is fully settled, so that legal heirs will not appear later to collect against the settlement.

The following surviiving persons are considered heirs in Utah and can make a wrongful death claim:

1) the decedent's spouse;
2) the decedent's children;
3) the decedent's natural parents, or if the decedent was adopted, then his adoptive parents;
4) the decedents stepchildren, IF they are minors at the time of the decedent's death AND primiarily financially dependent on the decedent.

If you have lost a loved one in an accident, it is important to educate yourself before making legal decisions. Visit www.UtahAccidentBook.com and get your free copy of attorney Ken Christensen's Utah Accident Book "7 Biggest Mistakes That Can Wreck Your Utah Accident Case." Its free!

The fall changeover from daylight savings time accounts for an enormous increase in pedestrian accidents and pedestrian fatalities. Researchers at Carnegie Mellon University studied pedestrian fatalities from seven years of pedestrian accidents. They found that the number of pedestrian accidents and fatalities jumped 186 percent during October and November. By December, the number dropped by 21 percent. With darkness falling an hour earlier, the researchers concluded, drivers and pedestrians alike are slow to adjust. As a result, the risk to pedestrians nearly triples. Darkness calls for greater caution while driving. Please lookout for pedestrians and bicycles.

7 Year-Old Draper Boy Hit While Crossing Street in Crosswalk

According to KSL.com a 7 year-old student at Draper Elementary was hit by an inattentive driver while crossing the street in crosswalk. The boy was thrown 40 ft at impact.
