Utah Woman Killed in Multi-Car Accident on I-15

Kristen Kay Taylor, 25, of Salt Lake City was tragically killed in a multi-vehicle accident on Wednesday afternoon of March 10, 2010. Utah Highway Patrol reports that the heavy snow storm over I-15 near Cedar City created such limited visibility that a serious of catastrophic car accidents took place within minutes.

Facts of What Caused the Fatal Car Crash

13 vehicles were involved in 3 separate car collisions that tragic afternoon alone. Ms. Taylor was a victim of the second accident. The first crash involved two vehicles and two tractor-trailers. Five cars stopped for the initial car accident. Ms Taylor, driving a Kia Spectra, stopped behind a tractor-trailer but the semi truck driving behind her did not stop in time. The semi truck struck Ms. Taylor’s Kia with enough force to smash it against the semi in front of her. A third car then hit the semi, causing further damage.

Ms. Taylor was killed at the scene of the car accident. Utah Highway Patrol Trooper Cameron Roden stated in a Salt Lake Tribune report that the male passenger in the Kia, believed to be Ms. Taylor’s fiancée, was seriously injured and his arm amputated may have to be amputated. He was taken to Dixie Regional Medical Center in critical condition. Several passengers and drivers of the multi-car crash were also taken to the hospital for medical treatment.

I offer my deepest condolences to the family and friend who loved and knew Kristen Kay Taylor. I will keep them in my prayers as they go through the difficult grieving process of losing a loved one so suddenly. I also pray for Ms. Taylor's finance that he may recover. I hope that the other injured victims heal from their injuries quickly and completely.

Fault and Liability

It appears that the driver of the semi truck is liable for the wrongful death of Ms. Taylor and the injuries to her passenger. The at-fault driver could be held liable for the accident, injuries and damages caused by his negligent driving behavior. The personal injury and wrongful death claims may be complex as the trucking agency is probably from out-of-state. A skilled wrongful death attorney has expertise dealing with national insurance companies and Utah Law. The experienced Salt Lake City personal injury attorneys at the Christensen Law Firm help Utah victims and their families better understand their legal rights and options so they can focus on healing from their tragic loss.

A sixteen-year-old girl was ejected from the side window of a suburban that was involved in a multi-car crash in Riverton on Tuesday morning of March 9, 2010. Utah. ABC News reports that after being thrown through the glass window, the young woman immediately picked herself off the ground and got back into the car. Fortunately, emergency crews from Unified Fire arrived and assessed that the victim was in shock and in serious condition with possible internal injuries and severe pelvic trauma. Life flight quickly responded and transported the young girl to Intermountain Medical Center where she received medical treatment. The driver and passengers of the Jeep and the second passenger of the suburban all sustained injuries and were transported to the hospital via ambulance.

What Caused this Near Fatal Utah Car Collision

The multi-car accident occurred at 12600 South and 2700 West near Riverton High School. A suburban attempted to complete a left hand turn and instead T-boned a Jeep traveling with oncoming traffic. The force of the impact propelled the Suburban into another collision with a vehicle that was stopped at the intersection.

Citations have not yet been issued, as police are still investigating the cause of the car accident. All passengers have PIP insurance under the insurance policies of the vehicle they were riding in. In such cases, victims can seek compensation from the at-fault party for medical expenses, lost wages, cost of hospitalization, rehabilitation, physical therapy and other related expenses.

Spanish Fork Semi Truck Accident Kills 24-Year-Old

Fatal Head on Collision with Semi Truck Kills One and Critically Injures Another

Immense tragedy struck two families on Saturday afternoon of March 6, 2010. 24-year-old Trent Walker of Utah County was driving home from a funeral service near Birdseye, Utah, when he was involved in a fatal car crash with a semi truck. Utah Highway Patrol Trooper Todd Johnson confirmed that Mr. Walker crossed the center line and caused a head on collision with a semi truck. Mr. Trent Walker died at the scene of this horrific accident and Mr. Slobodan Spanovic, the 45-year-old driver of the semi truck was flown to University of Utah Hospital in Critical condition. The Salt Lake Tribune reported this morning that Mr. Spanovic has now been released from the hospital.

My heart goes out to both victims of this terrible car verses semitrailer accident. I pray that Mr. Walker’s family and friends have support as they go through the difficult process of grieving the sudden loss of a loved one. I hope that Mr. Spanovic fully recovers from the serious injuries he sustained in this tragic accident.

What Caused this Fatal Utah County Car Accident?

Aggressive driving behavior may have been a factor in this accident. Utah Highway Patrol confirmed in a KSL news report that the driver of the pickup truck was trying to pass another car at the time of the head on collision with the semi truck. U.S. Highway 89 in Spanish Fork Canyon is a curvy mountainous road that offers limited visibility of oncoming traffic. As personal injury attorneys that serve victims of Utah County automobile accidents, we highly advise waiting until a designated passing lane is available before attempting to pass slower traffic. Crossing the center line in order to pass traffic is an example of aggressive driving according to the Federal National Safety Council and it is against Utah State traffic laws. The fatal consequences of such driving behavior occur much too frequently.

Utah Teen Dies in Fatal Idaho Car Accident

Fatal Rollover Accident Details

On the morning of Monday March 1, 2010, 17-year-old Eaity Emich of Utah died after being involved in a fatal rollover accident on I-84 in Idaho. The driver, 20-year-old Rex Sanasan of Clinton, Utah, had fallen asleep at the wheel, which caused the vehicle to veer off the road. Mr. Sanasan awoke and overcorrected, which caused the vehicle to roll several times. The three passengers, Eaity, Bennett Barry, 22, and 9 –year-old Keio Takky, who were not wearing their seatbelts, were ejected and sustained critical injuries. Bennett and Keio remain in serious condition at St. Alphonsus Regional Medical Center in Boise. Mr. Sanasan and his front-seat Passenger Kevin Elimo were wearing their seat-belts on this fatal car accident and have been treated at Twin Falls Hospital for non-critical injuries. The Deseret News reports that alcohol was not a factor in this tragic rollover accident that killed one Utah teenager.

I offer my deepest condolences to everyone who knew and loved Eaity Emich for their tragic and devastating loss. My heart goes how to the driver Mr. Sanasan and his injured passengers for the difficult times that lie ahead. I hope they all will heal emotionally and physically from this catastrophic event. Please keep them in your prayers.

Drowsy Driving Kills

Fatigued or drowsy driving is just as dangerous as being an intoxicated or impaired driver. If you are tired and in danger of falling asleep, your reaction time to avoiding collisions or potential road hazards is significantly reduced. If you fall asleep, you lose that ability to react completely and will most likely overcorrect your vehicle while in panic mode when you are awakened. If you are tired its best to pull over—it’s impossible to predict when you may accidentally doze off. The lives and safety of yourself, your passengers and other motorists are threatened when you engage in drowsy driving.

How do you know if You are a Drowsy Driver?

• You can’t stop yawning.
• You drift out of the lane or hit a rumble strip.
• You don’t keep a constant speed—you slow down or speed up frequently.
• You don’t remember the last few miles you have driven.
• You have “monkey mind” or wondering thoughts.
• You can focus or keep your eyes open.

National Statistics

The National Security Council predicts that these figures are a far below the actual numbers of accident caused by drowsy drivers each year due to the difficulty to prove that the motorist fell asleep or was falling asleep at the wheel when the accident occurred.

• Each year 100,000 reported car crashes are directly caused by drowsy drivers
• 72% of adult American men surveyed admitted to drowsy driving in the last year
• 54% of adult American women surveyed admitted to drowsy driving in the last year
• 37% of adults have report to having “dozed off” for a short time last year

South Salt Lake City Car Accident Kills Driver and Injures Two Others

On Monday, March 1, 2010, a 52-year-old man was killed when the car he was driving was T-boned by a pickup truck. As family members are still being informed of this tragic loss, the name of the deceased victim of this fatal Salt Lake accident has not been released. The driver of the truck failed to stop at the stop sign at the intersection of Main Street and 3530 South and caused the three-car-accident. According to Deseret News, the driver of the truck was upgraded from critical condition to stable condition. The driver of the third vehicle suffered minor injuries and has already been released from the hospital.

My deepest condolences go out to the friends and family members of the victim. This sudden and tragic loss will be difficult. I encourage these family members to speak to an experienced wrongful death attorney before making any decisions. I also pray for the speedy recovery of the drivers of the pickup and the SUV who were also injured.

Have You Run a Red Light while Driving?

Distracted driving was a major factor in this fatal Utah accident. The driver of the pickup truck ran through a stop sign because he or she either did not notice the sign or he or she ignored the traffic sign. As an experienced personal injury attorney of Salt Lake County, I have noticed a terrifying trend among Utah motorists. Many motorists try to take advantage of their commute by completing other tasks while they are driving. Multitasking is not a safe or legal option when operating a motor vehicle. I highly urge motorists to focus on driving in order to prevent Utah car collisions like this catastrophic fatal accident that took place yesterday. Take the following survey to see if you are a distracted driver.

Distracted Driving Questionnaire:

• Have you missed a stop sign or ran a red light because you were not focused on
driving?
• Have been forced to come to a screeching halt because you had not noticed traffic
slowing?
• Have your passengers complained or have been startled by your driving?
• Have you inadvertently made a wrong turn or ended up at the wrong destination
because you were not thinking where you were going?

Utah Car Accident Attorneys

There are several Utah accident attorneys out there but only a few are specifically trained in wrongful death claims and plaintiff’s rights. The skilled personal injury lawyers at the Christensen Law Firm have devoted their entire practice to these areas of law; quickly becoming the experts to contact if you or a loved one find themselves a victim of a Utah accident. What are the Fatal Four Driving Behaviors?

What is Defensive Driving?

The National Safety Council (NSC) has implemented an in-depth defensive driving course for motorists who have accrued enough points on their driving records that they are at risk of getting their licenses revoked. Most of these motorists have received multiple speeding tickets and have opted to take traffic school provided by the Utah Department of Motor Vehicles.

Defensive Driving is a serious skill that many motorists fail to take advantage of. More specifically, defensive driving protects motorists and their passengers from the potential dangers around them which include other vehicles, road conditions, and inclement weather conditions. Most of the hazards on the road are easily foreseen and thus these types of collisions are preventable. The fatal four driving behaviors according to the National Safety Council are:

• Speeding
• Right of Way
• Driving Left of Center
• Tailgating

Speeding Car Causes Fatal Car Accident for Utah Residents

The National Highway Traffic Safety Administration (NHTSA) reports that speeding is a contributing factor in fatal car crashes that kill around 13,500 people every year and costs $41 billion dollars annually. In fact, exceeding the posted speed limit by 10 miles doubles your risk of death in a Utah traffic accident.

Why do People Speed?

• Failure to monitor speed
• Not allocating enough time to reach your destination
• Ignoring speed limits

Understanding Who has the Right of Way

NHTSA attributes more car accident injuries to right-of-way violations than any other improper driving behavior. Some examples of the common causes of car accidents include:

• Failure to Yield
• Not paying attention to traffic signals and signs
— For example: Is that a green turning arrow or a “yield on green” sign at the intersection?
• Rolling through a Stop Sign or Red Light instead of coming to a complete stop

Driving Left of the Center is Never Necessary

Driving left of the center means crossing the center line. Crossing the center line has a potentially fatal risk of causing a head-on collision. Remember, crossing the center line isn’t necessary. It is much wiser to avoid the practice of doing this altogether.

Tailgating Kills

Following too closely is an unsafe driving habit that contributes to road rage, speeding and motor-vehicle collisions. Rear-end accidents result in severe spinal injuries, traumatic brain injuries and even death. Maintain a safe distance from the vehicles around you, so that you can stop efficiently and safely.

Canadian Woman Killed in Utah Pedestrian verses Auto Accident On February 25, 2010, Patricia Prokopetz of Alberta, Canada, died after being hit by a car on I-15 near Willard Bay. The Salt Lake Tribune reports that Patricia Prokopetz and her husband had traveled to Utah so that Mr. Prokopetz could receive medical treatments for he aggravated diabetes. On this tragic Thursday, Patricia decided to take a photograph of Willard bay. The couple pulled over so Patricia attempted to run across the free way for a better shot. She was struck by a minivan traveling in the far left fast lane. Although Patricia was airlifted to the hospital, the injuries she sustained in this tragic Utah pedestrian verses auto accident were too great. She died from her traumatic injuries at the hospital. Fortunately, no one was hurt in the minivan. My heart goes out to the family and friends of Patricia Prokopetz. This was a tragic and preventable accident that will no doubt have lasting effects on the loved ones of the victim as well as the occupants of the minivan, who were not responsible for causing this fatal Utah Car accident. Utah Pedestrian Accident Statistics The Utah Department of Health has created a special task force called Violence & Injury Prevention Program (VIPP) to research what kind of injuries and accidents Utah resident are more susceptible to become involved in and why these types of accidents occur. By analyzing thier data and findings, VIPP creates and implements safety programs that aim to promote education, awareness and safety for the inhabitants and visitors of our lovely state of Utah. In 2004, the Salt Lake City/Ogden area was ranked as the 31st most dangerous metro area nationwide for pedestrian safety by the Surface Transportation Policy Project (STPP). This report generated great public concern and compelled Utah government officials to create safety committees specifically designated to the safety of pedestrians, children, bicyclists, motorcyclists and other groups prone to auto accidents. According to the most recent data provided by VIPP, pedestrians in Utah are just not that safe: • In Utah, on average, 40 pedestrian are killed each year • Each year, 1,055 pedestrians are struck by a car • 50% of these pedestrian verse car accidents involve persons under the age of 19 • 60% of pedestrians hit by cars are male Informative ResourcesPedestrian and Bicycle Information CenterZero FatalitiesHeads Up Utah Campaign An Experienced Attorney Can Help You The Salt Lake City pedestrian injury attorneys at the Christensen Law Firm closely work with their clients affected by Utah accidents to help insure that they receive fair compensation for their injuries. Drunk Teen Driver Injures Pregnant Murray Woman

Early this Thursday morning of February 25, 2010, two teenage kids, allegedly driving under the influence of alcohol, crashed through the home of a 7 month pregnant woman and her one year old son. KLS news reports that Sgt. Ross Huff of the Murray Police Department confirmed that the car landed on the bed next to the sleeping woman. She was able to immediately exit the destroyed room to get her son and run to outside to safety.

Fortunately, the woman sustained minor injuries and her toddler were unharmed in this Utah car accident. The teenage drunk drivers also suffered minor injuries and were treated at a local hospital. Although one of the teens fled from the scene of the accident both were quickly caught by police officers. The teens are reportedly not cooperating with Murray police authorities on answering who was driving. The charges that are pending include: for driving under the influence of alcohol, hit and run with injuries, running a red light and lying to police officers.

I hope that this brave woman fully recovers from her physical injuries and her psychological trauma and that there are no long lasting injuries to the unborn child. I also pray that the toddler was not traumatized by having a car crash through his home.

How Did this Car Crash through a Murray Home?

Witnesses stated that the vehicle driven by the allegedly drunk teen sped through a red light at the intersection of 4500 South and 500 East in Murray, Utah, hit the curb which launched the vehicle into the air. The vehicle then flew 45 feet, onto a parked car and then through the house of the Murray woman. While it seems clear that alcohol was the main factor in causing this Utah hit and run motor vehicle accident, the snowy road conditions could have also played a role.

Complex Insurance Issues Apply in this Bizarre Utah Auto Accident

• Medical treatment to all injured parties
• Property damage to house and fence
• Compensation for all the personal belongings destroyed in the motor vehicle accident
• Property damage to both vehicles involved in this car accident (the car the teen was driving and the parked car that was hit)

There are several factors that influence who will be paying for the medical injuries sustained by the woman, her child and the two at-fault teen drivers. Assuming the teen has auto insurance coverage; his personal injury protection portion (PIP) will cover the initial medical bills for all those injured.

Who Pays my Property Damage?

However, the insurance complexities deepen when we discuss who will pay the property damage portion of this Utah drunk driving accident. As described above, there are clearly thousands of dollars in property damage. More than likely, this teen driver will have only purchased the bare minimum requirements for collision coverage in Utah. The insurance company will only pay up to those limits which usually leaves the victims responsible for any further damages associated with this accident.

Do I have Home Owner’s Insurance?

To receive further compensation for property damage and other costs, the victim may be able to file claims under the at-fault party and their own home insurance policies. We highly advice that the victim and her family contact an experienced Salt Lake personal injury attorney right away to discuss her legal rights and options as well as the intricacies of the insurance world that she is about to face.

Texting and Driving Accident Victims File Claim Against Allstate Insurance Company

Dangers of Texting While Driving on Utah Roads

On August 2, 2009, Hailey and Shawn were driving northbound on I-15 near the 2-15 Belt Route when traffic slowed down to a stop due to the construction on the freeway. A young man, who was texting while driving, failed to notice and rear-ended Hailey and Shawn. The at-fault motorist was driving 65mph on impact and totaled Hailey’s Honda Civic. Although the vehicle was equipped with air bags and our clients were wearing their seatbelts, they both hit the windshield with their heads and sustained serious injuries to their heads and faces.

Hailey was transported to the hospital for immediate treatment for her head trauma, hip contusions and neck injury. Shawn received treatment for his spinal injuries and back injuries as well as for his multiple facial lacerations from the broken glass. To this day, he still suffers from memory loss and headaches. However, Shawn considers himself lucky. There were construction workers on the road near where the accident occurred. If the at-fault driver had hit these workers while he was distractedly driving, someone could have been killed in this Utah texting and driving car accident.

Texting while driving has increasingly become a safety problem for Utah motorists and their passengers. Despite it being against Utah State Law to text and drive, reckless motorists continue to send or read texts and emails while driving which puts everyone at risk of being involved in a fatal car accident. Join with Zero Fatalities, Oprah’s No Phone Zone, and Utah Bike Coalition to put an end to texting while driving in Utah.

When Insurance Adjusters Win, Accident Victims Lose

Despite the fact that the at-fault driver was breaking the law by texting and driving, when he caused the Utah car accident, Allstate Insurance Company only offered Hailey and Shawn $2,000.00 more than their medical bills. Understandably, Hailey and Shawn were disappointed and distraught at Allstate’s settlement. The at-fault driver’s blatant negligence caused several damages to this young Utah couple including:

• over $10,000 in medical bills,
• total loss of their vehicle,
• months of treatment, and
• Shawn was laid off from his job. Due to his injuries, Shawn was not physically able to keep with his workload.

Insurance companies, like Allstate, will not offer a reasonable settlement when they realize that the accident victims are not being represented by an experienced personal injury attorney. Too often insurance adjusters are successful in manipulating innocent accident victims. Insurance adjusters are rewarded through raises and bonuses for every dollar they don’t pay out in your personal injury claim.

Statistics demonstrate that by hiring a good personal injury attorney, victims receive an average of 3x larger settlement offers from Insurance Companies than if they filed a personal injury claim on their own.

Three things NOT to do When You are Involved in a Utah Accident

• Don’t speak to the at-fault party’s insurance company adjuster before speaking with an experienced Utah car accident attorney
• Don’t give recorded statements to anyone. Despite what the insurance adjuster says, you are not required to give a recorded statement to your own insurance company or the at-fault insurance company.
• Don’t sign any documents until you have spoken to a skilled personal injury attorney.

Are Utah's Children at Risk

Utah has a wonderful reputation for being a state that values family and community. The Salt Lake Valley is considered a beautiful Mecca for raising families. In fact, the US Census Bureau estimates that 36% of residents are under the age of 18. With such a large child population it is important that Utah resident teach youngsters how to stay safe.

Child Accident Statistics

Traffic Accidents
• Nearly 250,000 children are injured every year in car accidents.
• The National Highway Traffic Safety Commission found that 72% of the 3,500 randomly inspected car seats were being incorrectly used. This means that at least 72% of children are improperly restrained in their car seats.
Child pedestrian accidents account for 30%of all fatalities involving children under the age of 15 years.
• Approximately 50 children are injured or killed every week as a result of vehicles backing up.

Accidents

• More than 200,000 children ages 14 and younger are treated at the emergency rooms each year for playground related injuries

• More than 130 children die every year in bicycle accidents.
• 270,000 children are injured in bicycle accidents every year.

Fatal Provo Car Accident Leaves One in Critical Condition

Improper Lane Change Kills Provo Man

KSL News reports that on Thursday, February 18, 2010, a motorist made an improper lane change and hit a Chevy Cavalier on I-15 near the University Avenue exit in Provo. Due to the force of impact, the Cavalier spun out of control and the driver-side door opened, throwing both the driver and his passenger out and onto the asphalt of the highway. Neither of the victims was wearing their safety belts. Both victims were transported to Utah Valley Regional Medical Center where the driver died for the injuries he sustained in the car accident. The passenger is reported to be in critical condition. The motorist of the Buick did not suffer from any injuries or receive any citations at this time. The Utah Highway Patrol is still conducting their investigation of the important factors in why this fatal car accident occurred. The names of those involved in this horrific fatal Utah car accident have not been released yet.

My deepest condolences go to the family and friends of the deceased victim. I understand that difficult times are ahead as they must cope with the sudden loss of a loved one in this tragic car accident. Our thoughts and prayers go to the victim who was a passenger in the Cavalier. We hope for a full and speedy recovery from the serious injuries sustained in this unfortunate accident.

Four Important Factors to Address

• Did the driver of the Buick signal properly before changing lanes?

• Why did the doors of the Cavalier open? There might be malfunction on the part the manufacturer of the Chevy Cavalier doors. Upon impact or collision, the doors of an automobile should not open.

• Do the driver and passenger of the Chevy Cavalier bear comparative responsibility? They were breaking the Utah Law when decided not to wear their seat belts.

• The Utah Statute to file a Wrongful Death Claim is reduced to two years from the Date of the Accident.

How to Signal Properly

Signaling when turning or changing lanes is not only a courteous action to other drivers but it substantially reduces the risk of car accident occurrences on Utah Roads. Consequently, it is the law to know how to signal properly on Utah roads.

For most of us, it’s been a long time since high school Driver’s Education classes. Do you remember how long a motorist is required to have his or her turning signal on before actually changing lanes? A healthy habit to adopt is to annually review the Utah Driver’s Handbook. You can order one from the Utah Department of Safety (UDPS) or follow the link provided to download a PDF version for free. Following is a short summary of how to signal properly from the Utah Driver Division of the UDPS:

• Turn signals must be given two seconds
-before turning
-before changing lanes
-before you pull over or pull away from a curb

• When you intend on slowing down or stopping, your brake lights must be functioning properly to signal to other drivers

• It’s the law to have emergency lights flashing when your car is disabled on the highway

The time to file a car accident claim is limited, which makes contacting an experienced Utah County Auto Accident attorney as soon as possible of vital importance. Attorney Kenneth L. Lawsuit Filed against Farmers Insurance Company for Distracted Driving

Cell Phone Use and Distracted Driving

On October 6, 2007, Nancy Shelley and her husband Steven were driving through the intersection of 1600 North and 1200 West in Orem, Utah, when they were T-boned by a large SUV. The driver of the SUV was cited for running the red light and causing the accident. Witnesses and the Shelley family wondered what could have distracted the motorist from seeing the red light at the intersection. The wondered whether the at fault driver impaired by drugs or alcohol?

After a thorough investigation, Orem City Police reported that the at-fault driver had been talking on his cell phone when the accident occurred. The driver had been so focused on the conversation he was having that he failed to notice the traffic lights. Unfortunately, cell phone use by motorists causes inattentive driving, which has increased the number of Utah car accidents and accident fatalities by an alarming rate.

Statistics

The correlation between texting or talking on a cell phone while driving and increasing the likelihood of causing a motor vehicle accident has been confirmed by several studies. In the Highway Safety and Statistics Report released in September of 2009, the National Highway Traffic Safety Administration (NHTSA) reported that distracted driving caused by cell phone use was increasing at an overwhelming rate nationwide. Several states have attempted to curb this dangerous trend by banning texting while driving or the use of handheld cell phones by motorists. However, many studies demonstrate that any type of cell phone use—texting, talking, emailing, and even listening to conversations—is especially distracting to motorists. The alarming statistics for 2008 are as follows:

• 5,870 people died in car accidents caused by distracted driving
• 515,000 people sustained injuries in car accidents attributed to distracted driving
• 16% of all fatal crashes were due to driver distraction
• Motorists 20 and under are most likely to cause car accidents due to distracted cell phone use
• Daily, 800,000 motorists are driving while using their cell phones

Scare Tactics Used by Insurance Companies

Nancy and Steven originally thought they did not need an attorney for their Utah personal injury claim because the facts of the accident seemed clear cut. The at-fault driver, driving recklessly because he was distracted on his cell phone, ran a red light which resulted in the high impact collision with the Shelley family’s vehicle. The injuries Nancy sustained in this automobile accident were serious—a fractured arm, a fractured ankle, and injuries to her neck and back. For some time, Farmers Insurance Company gave the Shelley family the go-around. Farmers Insurance questioned Nancy’s treatment. They asked for prior medical records and other documentation. The insurance adjuster did not return phone calls. Not once did Farmers Insurance provide Nancy with an offer of settlement. Farmers Insurance Company was complying with a commonly used insurance strategy in their attempts to hold off negotiations until the Utah Statute of Limitations expire and Nancy would be left to pay for all her accrued medical bills.

What an Experienced Personal Injury Attorney Can Do for You

After reading the book 7 Biggest Mistakes that can Wreck Your Utah Accident Case, written by attorney Kenneth L. Christensen, Nancy and Steven made an appointment with The Christensen Law Firm, PLLC. A decision that the Shelley family is grateful they made. Ken Christensen has filed a lawsuit against Farmers Insurance Company for the policy limits of their insured, the at-fault driver. Nancy now has the sense of security and comfort knowing that she will receive compensation to cover the costs of her current and future medical treatment. They are also pursing compensation for Nancy’s pain and suffering, lost wages and more.

Head on Collision Leaves Five People in Critical Condition in West Valley City

The snow storm that hit the Salt Lake Valley early Thursday morning made for bad driving conditions and directly affected commuters during rush hour traffic. Car accidents, unplowed roads and low visibility slowed traffic by up to a reported 45 minutes on I-15 southbound near Provo. Unfortunately, on 5400 South and State Road 111, in West Valley City, a car accident involving three cars left five people in critical condition.

What Caused this Utah Car Accident?

Around 7 am on February 11, 2010, three men in a pickup truck attempted to make a left hand turn when they crashed into an oncoming car. The pickup truck was then hit by another oncoming car. All three men in the pickup truck and woman in the car that were involved in the initial head on collision sustained critical injuries. The specifics of their injuries and the names of the victims have not been released to the public at this time. The driver of the third car also sustained injuries but has been released. Witnesses state that the low visibility may have contributed to the truck not seeing the oncoming small sedan. The Salt Lake tribune reports that citations have not yet been issued as West Valley Police Department are still conducting their investigation of what caused this Utah motor vehicle accident.

My concern and sympathy go out these car accident victims and their families as they go through this difficult time. I pray that they each make a speedy and full recovery from the injuries they sustained in this tragic Utah car accident.

How Weather Conditions Can Affect Rescue

Utah is known for its heavy snow storms that blanket the mountains and neighborhoods in the surrounding Salt Lake Valley. Last Thursday’s snow storm was no exception. Due to the severity of the storm, the life flight medical helicopters dispatched to the scene of this West Valley City car accident were unable to land. Consequently, all five seriously injured victims were had to be transported via ambulance to the emergency room at the Intermountain Medical Center. Fortunately, all victims were able to receive medical treatment in time.

Snow and Ice Car Crashes in Utah

On December 28, 2009, there were an astounding 208 motor vehicle accidents on Utah Roads alone. Roads that are covered with ice and snow often cause a loss of control and skidding of a motor vehicle. Car tires have reduced traction during these conditions. Utah residents should take the initiative to have all terrain and weather tires put on their car especially if they do not drive cars with four-wheel drive. Here are some safety tips for driving in inclement weather conditions:

• Drive with your lights on to promote visibility
• Scrape off all the snow off your vehicle. This included all windows and the top of your car. Sudden stopping with cause the snow on the top of your car to fall onto the windshield of the car behind you.
• Check your tire pressure. Low tire pressure significantly reduced the traction ability on your tires.

What are Passenger Rights in Utah Car Accidents Cases?

Three Quick Tips

• Drivers and passengers that sustain injury in a car accident will each have a separate claim against the responsible party.
• Victims of Utah car accidents can file a personal injury claim against the driver of the vehicle they were a passenger when that motorist was the at-fault party.
• It’s common myth that if the driver of the vehicle was uninsured, there are no options or protections for the injured passengers.

Who Pays My Medical Bills?

According to Utah No-Fault Law, the primary insurance company for passengers who sustain personal injuries in a car accident is the insurance company of the driver/owner of the vehicle involved in the accident. This insurance company will provide the initial medical pay through Personal Injury Protection (PIP) benefits purchased by the driver. In Utah, the minimum amount of PIP coverage motorists must buy is $3,000 per person. While this amount is rarely adequate to pay all medical bills associated with treatment for victims of auto accidents, it does help. Unless the driver of the vehicle you were a passenger of did not purchase insurance, you and that individual should each have at least $3,000 for treatment costs.

Multiple Insurance Benefits May Be Available to You

What most Utah residents are unaware of is that there are several types of insurance policies and benefits that can be applied simultaneously for specific types of motor vehicle accidents that involve injured passengers. However, with all insurance policies, there is fine print that can be difficult to understand. Filing paperwork incorrectly or providing certain types of information in recorded statements can negate your right to access these benefits. We highly recommend speaking to an attorney before signing or agreeing to anything.

Also, depending on the type of accident, the passenger who was a victim of a car collision may be entitled to multiple insurance claims and settlements. Again, the legalities and issues surrounding these areas are complex and best navigated by an personal injury attorney who has significant experiences with working with numerous insurance claims at one time and extensive knowledge of Utah law.

Case Study

Mary M., one of our clients, was involved a passenger in a vehicle that was t-boned during a snowstorm a few years ago. Unfortunately, Mary sustained serious injury that required intensive surgery that required her to miss months of work. In his immediate investigation, Attorney Ken Christensen discovered that Mary qualified for benefits under four different auto insurance policies, including her own insurance coverage. By acting quickly and efficiently, Mr. Christensen successfully constructed a clear plan of how each policy would provide maximum benefits without “stacking” or breaking any state law.

With mounting medical bills and not being able to work, Mary faced debt; however, due to the ability Mr. Christensen demonstrated in collaborating insurances’ med pay, loss of services etc. the potential financial damage was thwarted. In the end, Mary received substantial settlements from each insurance company and has been able to fully recover from her injuries.

Junior High Girl in Critical Condition After Being Hit by a Car

A fourteen year-old junior high school student was hospitalized in critical condition early this Monday morning of February 8, 2010, after being hit by a car. According to the report by Deseret News, the pedestrian verses car accident occurred around 7 a.m. at the intersection on 2700 South and 8500 West. Witnesses state the young girl was walking with other students who were on their way to Brockbank Junior High School in Magna when the accident occurred. Unified Fired Authority Captain Clint Smith, who was among the responding police officers, confirmed that the young girl was walking in the designated crosswalk when she was hit by the distracted driver. He also confirmed that the young girl sustained severe head injuries and was flown to the University of Utah Hospital. The cause of the accident is still being investigated.

My thoughts and prayers go out to this young girl that she make a speedy and full recovery so she can get back to the care free life of being a child. My condolences go out the her family, friends and loved ones as they go through this difficult time with her.

Pedestrians are more likely to be Critically Injured in an Accident

An impact with a two ton vehicle going at a high rate of speed will obviously cause significant damage to the much more vulnerable human body. Tragically, often times pedestrian verses motor vehicle accidents cause major injury such as traumatic brain injury that could result in irreversible brain damage or spinal cord injury that could result in paralysis. Unfortunately, many of these accidents result in the death of the pedestrian.

Pedestrian Accident Statistics

Statistically, males are more likely to be involved in a pedestrian verses motor vehicle accident than females. Consistently, 69% of pedestrian fatalities each year are males. The National Highway Traffic Safety Administration reported the following statistics in 2005:

• 20% of pedestrian deaths were of males
• 45% of pedestrian vs. motor vehicle accident deaths occurred between 6pm and midnight
• The vast majority of fatal pedestrian vs. car collisions occur on Friday, Saturday and Sunday nights.

With this information, it may be wise to educate our young men to engage in weekend activities indoors and away from intersections in the dark hours of the night. Visibility is significantly impeded in dark. Speeding cars or distracted motorists will have an increasingly difficult time seeing young men skateboarding or walking around at night.

Liability Issues Involved

In this tragic pedestrian verses automobile accident, there are several questions to address to confirm the cause and liability of the accident. While it has been confirmed the victim of the car crash was crossing in a designated crosswalk, was the crosswalk a marked or unmarked intersection. If the answer is yes, the driver will most likely be cited for failing to yield to the right of way to the pedestrian. What had distracted the 21 year-old driver of the vehicle that hit the junior high student? Was she talking on her cell phone, speeding or driving recklessly at the time of the collision?

An experienced Salt Lake personal injury attorney will take the necessary steps to find the answers to these questions and will preserve the evidence needed to demonstrate the responsibly of the at-fault driver.

If you or someone you love has suffered through a Utah pedestrian injury and you feel it is the result of the negligence of another, we urge you to contact the Christensen Law Firm online or call us at 801.506.0800 to set up a FREE consultation to discuss your legal rights and options.

West Valley City Employees: Worst Drivers in Salt Lake Valley

According to a recent report released by the Salt Lake Tribune, car accidents caused by West Valley City employees, while driving city vehicles, have increased by an astounding 54% in the last year. West Valley City employees cost the city over $107,000.00 in damages so far for 2009. This amount is likely to rise as there are still pending personal injury claims that have yet to be settled. Utah residents are angry that instead of spending public monies in areas like health care or education, these funds are being funneled into paying for reckless and preventable accidents caused by city employees.

West Valley Police Officers Overwhelmingly At-Fault in Car Accidents

West Valley City Attorney, Richard Catten, explained to the public that WVC employees have increasingly been cited for causing minor accidents like backing into other vehicles, mail boxes, trees or rear ending other motor vehicles. Distracted driving is a key characteristic of these types of accidents and the damages are not cheap. For example a city employee, driving a WVC water truck scraped his truck against two parked cars when making a right turn. The city employee was not observant that he was driving an extra wide load and his mistake cost the city $11,000 in property damages.

Interestingly, the report demonstrates that West Valley City police officers caused 37 of the 60 at-fault car accidents in 2009. In fact, for the past three years, police officers have consistently caused 60% of at-fault traffic accidents.

• One officer attempted to make a U-Turn over a median and got stuck. This accident cost the city $6,000.

• Another police officer rear ended a vehicle causing $14,000 in property damages and injuring the driver of the other motor vehicle.

Warning:
Your Ability to File a Utah Personal Injury Claim is Affected if a Government Entity is Involved

Utah statute of limitations is an important timeline that designates your window of opportunity to file a claim against the responsible party. If the statute of limitations expires, you may no longer bring a case to court. In standard Utah motor vehicle accidents, the statute of limitations is four years. However, In the State of Utah, the statute of limitations on filing a personal injury claim is decreased to one year if the at-fault party is a government agency.

Attorney Ken Christensen’s book Seven Biggest Mistakes that can Wreck Your Utah Accident Case contains additional information on Utah Traffic Laws and guidelines on how to file an insurance claim for bodily injury. It is an invaluable resource that offers real life education and advice on how to protect yourself if you have been in a Utah personal injury accident. Give the Christensen Law Firm a call to request a FREE copy of this book at 1.801.506.0800 or visit us online at www.utahaccidentbook.com.

WVC Fire Department Takes Action to Curb Accidents

Several years ago, the West Valley Fire Department also experiences a substantial increase in accidents. Most of the accidents were from hitting objects when backing out. WVC instated a policy that a “spotter” is designated whenever the fire truck backs out of any premise. The results have been significantly positive: the department has seen a 50% reduction in their at-fault truck accidents. If West Valley City were to implement basic changes on employee driver protocol, training and safety then the West Valley City won’t lose so much public money on preventable car accidents. Increased driver’s education on how to on how to maneuver government vehicles properly and how to avoid distracted driving will be quite beneficial to all.

Why You Shouldn’t Answer when Progressive Insurance Knocks at Your Door After an Accident

Case Summary

Tragedy struck when twenty-six year-old Kody was driving home from work in Orem, Utah, on January 20, 2010. A man driving a Nissan Pathfinder ran a stop sign and struck Kody’s vehicle on the driver’s side. The force of the impact caused the airbags to deploy and totaled the small sedan. Kody sustained several neck and back injuries from the car crash. The Orem City police responded to the scene of the car accident and issued a citation to the driver of the Nissan Pathfinder for failing to stop at a stop sign and failure to yield to oncoming traffic.

Insurance Company Lets At-Fault Party off the Hook

According to the facts of this Utah car accident, it is clear who is at-fault and who should be held responsible for the car accident. However, in less than 48 hours, Progressive Insurance Company had an adjuster physically knock on Kody’s door. The Progressive Insurance adjuster was quite devious. He was “checking on their insured,” but he brought paperwork for Kody to release personal medical and employment information. The insurance adjusters told Kody that in order to cooperate with the investigation, Kody had to give a recorded statement.

When the Progressive adjuster offered to settle Kody’s claim for $500.00 by telling the young man that the car crash was non-reportable and a claim wouldn’t be worth pursuing, Kody knew he was being backed into a corner. The Progressive adjuster stated the insurance company was going above and beyond their services by offering money at all for this car accident. Kody was confused. He had been speaking to adjuster because his own automobile insurance company was Progressive Insurance Company. The Insurance adjuster was working both sides—the at-fault driver’s automobile insurance was also Progressive Insurance Company.

Would An Insurance Company Victimize their Own Insured?

Kody asked the Progressive Insurance adjuster whose side he was on—the gentleman that hit him or his. The adjuster didn’t lie but he was clearly conflicted when he stated he worked for Progressive and work for their insured’s best interests. The adjuster told Kody the money would go directly into his pocket. That PIP would take care of medical expenses (but PIP only covers $3,000 in medical bills and Kody's treatment will exceed that amount). Kody could feel the manipulation and fortunately asked the adjuster to leave. After seeing the television ad for the informative guidebook 7 Biggest Mistakes That Can Wreck Your Utah Accident Case, Kody called the Christensen Law Firm. In just a week, Ken Christensen has been able to straighten this matter out which allows Kody to focus on healing and recovery.

Unfortunately, Insurance companies are not looking out for the best interests of their insured. They are a for-profit company. Insurance Companies don’t maximize their profits if their adjusters explain all the benefits their insured has purchased in their automobile insurance policy. In this case, Progressive Insurance made it painfully obvious that their main priority was profit—not Kody’s medical treatment, property damage, and further damages and losses he incurred as a result of the car crash.

Number One Misconception in Utah Car Accident Cases:

My insurance company will ensure that my best interests are met including receiving a fair settlement and payment for lost wages, medical bills, pain and suffering and property damage.

Remember: Insurance Companies have no obligation to inform you of your rights.

Salt Lake personal injury lawyer Kenneth Christensen authored the book 7 Biggest Mistakes that Can Wreck Your Utah Accident Case in his endeavors to level the playing the field between accident victims and the insurance company. This book provides Utah residents with valuable information and corrects many of the myths associated with insurance claims and provides detailed information on the tactics insurance adjusters use to maximize their profits. Fatal Taylorsville Car Accident Kills Woman and Critically Injures Two

Summary

Charlotte Kirk, a 55 year-old Salt Lake City woman, died in a car accident on Monday February 1, 2010. The fatal car accident occurred around 6:30 pm on Redwood Road in Taylorsville, Utah. Ms. Kirk was attempting to make a left hand turn when her truck crashed collided with an oncoming vehicle. The passenger in Ms. Kirk’s truck and the driver of the other truck were both critically injured in the motor vehicle accident. Both were transported to Intermountain Medical Center via ambulance where they continue to receive medical treatment for the traumatic injuries they sustained. Detective Shannon Bennett of Taylorsville Police Department confirmed in a Salt Lake Tribune interview that the investigation is ongoing. Until the cause of the Utah car accident is established, citations will not be issued to either driver.

My heart goes out to the family and friends of Charlotte Kirk for their tragic and untimely loss. I offer my deepest sympathies to them. I hope the two injured victims make a complete and full recovery from their injuries sustained in this catastrophic accident.

Statistics on Left Hand Turn Accidents

• 42% of all motorcycle verses car collisions involve left turn accidents

Usually the motorist is the at-fault party in left hand turning accidents. The operator of the motor vehicle turns left in front of an oncoming motorcyclist that they fail to see. Unfortunately, the motorcyclists and their passengers commonly sustain catastrophic injuries in these types of accidents.

Who is At-Fault when Turning Left on a Yellow Light?

Failure to yield to the right of way of oncoming traffic when making a left turn is considered negligence. The operator of the vehicle that is turning left is usually cited and officially considered responsible for the accident even if the light was yellow. There are factors that come into play in these types of accidents. If the light was changing to red and the oncoming vehicle sped past the speed limit to make the light, that motorist may be at fault. If other cars in the oncoming lanes had already stopped, this car should have stopped as well. It is imperative to get the witness statements and their contact information at the scene of an accident to clarify these circumstances. Insurance companies will point fingers in their attempt to fight liability. It is wise to contact an experienced Salt Lake City personal injury attorney in this situation. It is proven that an attorney is more likely to get the at-fault party to accept responsibility for the accident. Remember:

• Be extra cautious when turning on yellow lights
• Wait for the oncoming vehicles to slow down to a stop before turning
• Get witness statements and contact information from witnesses
• Take photos of the scene of the accident

Ryder Truck Kills Motorist in a Multi-car Crash in Sardine Canyon Today

Tragedy strikes the small town of Wellsville, Utah, near Sardine Canyon early this morning of February 2, 2010. A four vehicle car crash resulted in the death of 54 year old Robert Smith. Mr. Smith was declared dead at the scene of the Utah car accident.

How did this car accident occur?

Witnesses say a Ryder rental truck crossed the center line into oncoming traffic. The truck hit the small sedan Mr. Smith was driving in head on. Two seventeen year olds were critically injured and taken to the hospital. The driver of the truck only suffered minor injuries. The Utah Highway Patrol is investigating whether drowsy driving caused the truck driver to lose control of his vehicle.

My heart goes out to the family and people who knew and loved Mr. Robert Smith. My prayers go out to them as they face a difficult road of losing a loved one in an instant due to the negligence of another person. My thoughts and prayers also go out to the young teenagers who seriously injured in this car accident. I hope they make a complete recovery.

Icy Canyon becomes Death Trap

Witnesses at the crash, most of them morning commuters, stated that the cold weather and icy road create a “death trap” for motorists that are not familiar with the curves and windy Sardine Canyon. One witness, Matt, stated how many times he has seen a reckless motorist speeding through the canyon on his way to work in Brigham City. Matt was one of the commuters who waited hours after the fatal crash this morning. He stated that the wreckage was so bad that he is surprised anyone survived at all. The Audi and the yellow sedan were completely demolished.

Contacting an Experienced Utah Personal Injury Lawyer

I would urge the family members of the deceased victim and the injured victims in this case to get in touch with an experienced Utah personal injury lawyer who has successfully represented victims injured in multi-vehicle accidents. A skilled injury lawyer will also be able to explain to victims how their car insurance policy applies to an accident involving multiple parties as there is a cap or policy limit coverage on the insurance purchased by the driver of the Ryder Truck. This is assuming the individual who rented the truck had purchased car insurance. There are many factors in this case that can become confusing especially during this already difficult time.

We invite you to call the Christensen Law Firm and set up a no obligation free consultation with one of our experienced attorneys. This will provide you with an opportunity to ask all your questions and to learn about the legal rights and options you that are available to you after you have been in a Utah car accident or wrongful death accident. Fatal Utah Car Accident Kills Entire Tooele County Family

Fatal Car Wreck

30 year old Kristi Westfall and her 21 year old boyfriend Jacob Herrera and their 9-month old son Damian all died from the injuries they sustained in the fatal Utah car accident in the early evening of Thursday January 28, 2010. Mr. Herrera was driving southbound on State Road 36 in Tooele County when he lost control of his Dodge Intrepid and crossed the road’s centerline. Mr Herrera swerved sharply in the attempt to bring his car back into the proper lane but he instead pulled his vehicle right in front of a semitrailer causing the fatal Utah car crash. Authorities are not sure what caused Mr. Herrera to lose control of his vehicle. The Salt Lake Tribune News reports that Officer Cameron Roden, responding Utah Highway Patrol officer, confirmed that none of the occupants were wearing their seatbelts. Tragically, the infant’s car seat was not buckled in either. All victims died from their traumatic injuries at the scene of the accident.

I offer my deepest condolences to the families and friends of Kristi, Jacob and Damian. This story is another heartbreaking reminder of the importance of wearing seat belts and properly buckling our children in their car seats. It is a real misfortune that this entire young family was lost in an instant. I hope the driver of the semi truck also heals from the injuries sustained in this tragic accident

Utah Seat Belt Laws

The Utah Department of Public Safety , Safe Kids Coalition, Utah Highway Patrol and other organizations fund and support several statewide initiatives to get Utah residents to buckle up properly whenever they drive or are passengers in vehicles. Properly wearing safety restraints greatly reduced your risk of being injured or killed in a car accident. Following are a list of Utah Seat Belt Laws:

• Utah Safety Belt Law requires all drivers and passengers to properly war safety restraints.
• Utah Police officer can stop a vehicle if they observe anyone 19 years of age or younger not wearing a seatbelt.
• If the driver or passenger not wearing a seatbelt is over the age of 19, the police officer must have another primary reason for stopping the vehicle. For example speeding or failing to properly signal.
• Children ages 0-8 are required to be correctly restrained in a car seat.

National Statistics

If you have ever wondered why car insurance is so high for teenagers and young adults it is because teens are at a much higher risk to be in a car accident with injuries than the average driver. In fact, nationally, teens have the highest fatality rate in motor vehicle crashes than any other age group. The National Highway Traffic Safety Administration attributes this unfortunate trend to teenagers’ unwillingness to use safety belts than adults. Following are some sobering statics on teenage car crashes from the NHTSA Safety Belt and Teens Report of 2003:

• Fatal car Crashes are the leading cause of death for 15 to 20 year-olds nationwide
• 2/3 of the 5,341 teenagers that died in car crashes in 2001 were not wearing their seat belts
• 18% of male high school student report they rarely or never use safety belts
• Teenagers 16-19 are 4x as more likely to die in a car accident than the average driver 25-69

Injured in a Utah Accident?

Enhance Your Medical Treatment with Physiatry

Personal injuries resulting from automobile, bicycle and motorcycle accidents often times affect various parts of the human body, necessitating different forms of medical treatment and specialization. Physiatrists coordinate multiple areas of medicine for an all-inclusive approach to treating a patient who has sustained numerous injuries.

Case Study

In 2007, when my client Maria was involved in a pedestrian verses automobile accident in Utah, she sustained spinal cord injuries, a broken leg and head trauma. Clearly, Maria had a long road to recovery ahead of her. Her physiatrist coordinated the medical treatment to enhance and build upon each other with the goal of bringing Maria to her maximum medical recovery stage in the most efficient and thorough manner.

Consequently, Maria was able to treat with an orthopedic surgeon to repair her broken femur and a physical therapist to restore strength and mobility. Maria then treated with a chiropractor and massage therapist for her neck and back pain. Finally, the symptoms of post traumatic stress disorder (PTSD) that Maria suffered from her minor head injury were addressed by a licensed psychologist.

What is Physiatry?

• Physiatry, commonly referred to as Physical Medicine and Rehabilitation (PM&R) is a specific area of medicine that takes on a comprehensive approach to solving neurological and musculoskeletal problems within the human body using less invasive procedures than surgery.

• Physiatrists are medical doctors who aim to find the source of pain symptoms their patients have and treat the ailment holistically until the patient has reached his/her optimal functional capability.

• Physiatrists emphasize the importance of addressing all the intricate parts associated with the illness, disability or injury in order to restore one back to his/her best possible health.

Comprehensive Plan of Physical Medicine and Rehabilitation

Physiatrists take on a multidisciplinary approach to treating patients that have a broad range of personal injuries and medical ailments. These conditions include:

• Chronic Pain Management
• Traumatic Brain Injury
• Spinal Cord Injury
• Amputation
• Sports Injuries
• Accident Injuries
• Stroke
• Musculoskeletal Pain syndromes
• Nerve Pain
• Neck and Back Pain
• Psychological Issues

According to the American Academy of Physical Medicine and Rehabilitation, the complete plan of physiatry may include a large range of medical doctors and medical professionals. To give you an idea of how broad these health professionals are, following are a few that victims of personal injury accidents commonly treat with:

• Physiologists
• Physical Therapists
• Chiropractor
• Massage Therapist
• Occupational Therapists
• Speech Therapist

Your Health is the Priority of the Christensen Law Firm, PLLC

Survivors of Deadly Car Accident Settle Wrongful Death Claim in Utah

Summary

On April 20, 2009, Cliff M. was driving northbound on I-15near 11400 South in Draper, Utah. Due to heavy traffic on the freeway, Cliff brought his Honda Civic to a stop. Shortly thereafter, a Grey Dodge Ram 2500 Mega Cab truck ran over the top of driver’s side of Cliff’s car. Client died at the scene from the traumatic head injuries he suffered in the car accident.

Cliff was a loving father to his children. He was the primary breadwinner for his family and he was referred as the emotional rock for his adolescent and young kids. Cliff had been married and divorced multiple times. He had several biological children with his previous spouses and he had some stepchildren with his current wife. This non-traditional family unit which made the legal issues in his wrongful death case convoluted.

Things can go from bad to worse

Martha, mother to one of Cliff’s biological children, received a phone call one day from an attorney, stating her child would get a small sum for their loss. Martha did not feel that the amount was fair and she did some research on her own. She realized that her daughter and Cliff’s other biological and stepchildren were entitled to additional benefits. A friend advised Martha to call The Christensen Law Firm. Attorney Ken Christensen was able to obtain a large settlement from American Family Insurance Company that was more than four times the amount the previous attorney had told her to accept.

Martha was merely protecting the children’s interests. They lost a father who had been an integral part of their lives. Through this settlement the children have substantial assets left to them for their future wellbeing. If she had not called the Christensen Law Firm, and a wrongful death claim was not made in behave of all legal heirs, her young daughter would have suffered immeasurable with no recourse. As a parent myself, my final wish would be to know that I had left my children provided for.

What are the Statute of Limitations?

While the statute of limitations for most Utah personal injury cases can be as long as four years, in a wrongful death case, the time frame is reduced to two years. The time frame may vary depending on the details of the accident. If a government entity is involved, that statute of limitations can be as short as one year from the date of the fatal car accident. It is wise to discuss the specifics of your situation with an experienced Utah personal injury lawyer to ensure that you and your family do not lose legal options available to you now.

Who are the Legal Heirs?

In many wrongful death accidents, the surviving family of the victims pursues legal action against the responsible party to bring justice and closure. At the Christensen Law Firm, we’re ready to assist people in the daunting process of navigating their way through the often confusing maze of Utah personal injury law. • What is the Utah Wrongful Death Act? How does it affect me and my family?
• Who can file a lawsuit against the responsible party?
• Are stepchildren considered heirs?
• How many wrongful death actions can be brought before the court? Does it change when there are multiple heirs?

Three DUI Arrests in Salt Lake City this Week Alone

Utah Woman Charged with DUI and Hit and Run with Injury

Summary:

Police confirmed today that the woman who allegedly caused multiple car accidents downtown on Thursday was in fact driving under the influence of alcohol.

On Thursday morning, January 21, 2010, Ms. Elfida-Eschler rear ended a vehicle, and then she fled the scene in her truck, and was finally stopped two blocks later after she hit a second vehicle. Ms. Elfida-Eschler then got out of her truck and attempted to leave the scene on foot. However, witnesses were able to keep an eye on this obviously disoriented woman until law enforcement officials arrived. Ms. Elfida-Eschler was arrested on suspicion of DUI and hit and run involving injury charges.

Unfortunately, the victims in the two other vehicles were sustained injuries. The second vehicle hit by Ms. Elfida-Eschler was pushed into oncoming traffic which resulted in another Utah car accident. Traffic was backed up along 300 West and 600 South.

I hope that the victims in these tragic Utah DUI car accidents make a quick and full recovery. It would be wise for them to contact a Salt Lake personal injury attorney to ensure that Ms. Elfida-Eschler, and other motorists who drive drunk, are held responsible for their reckless behavior.

3rd DUI Arrest in Utah this Week

Utah has a long tradition of being the state with the least number of DUI arrests and DUI fatalities to any other state in the nation. It’s surprising then to have several reported DUI arrests in Utah during the first two weeks of 2010. As you may recall, former Utah Senator Majority leader Sheldon Killpack-R of Syracuse was pulled over a week ago for drunk driving. Previously, an ATV driver in Salem, Utah, was arrested for crashing his all-terrain vehicle, fleeing the scene, and being under the influence of alcohol. And now Ms. Elfida-Eschler is arrested for drunk driving on Utah Roads.

Vegas Man Pleads Guilty for DUI and Causing Death

Tragically, often times the victims of alcohol-related accidents are innocent bystanders. On January 8, 2010, Deseret News reported that the Las Vegas man pled guilty to killing a Utah athlete in a DUI car accident in October of 2009. 33 year-old Jeremy Kunz of Kamas, Utah, was participating in the Ragnar Relay run in Nevada when Mr. Salayisch, who was driving drunk, hit and killed Mr. Kunz. Mr. Salayisch then left the runner in the road and fled the scene. This unfortunate pedestrian verses automobile accident is a reminder of the catastrophic costs of a driving under the influence of alcohol.

Legal Issues

According to Utah law, the victims of alcohol related motor vehicle accidents have several legal options and resources available to them. Talking to an experienced Utah personal injury attorney can help you navigate through the complexities of the legal and insurance fields. Commonly asked questions include:

• How to file a personal injury claim?
• How to settle a property damage claim?
• Who files the criminal charges?
• How long do family members have to file a Wrongful Death Claim?

Pedestrian Severely Injured in Utah Car Crash

Pedestrian Severely Injured in Utah Car Accident

McKenzie, a 17 year-old Woods Cross High School student, was severely injured in a Utah pedestrian verses automobile accident in September of 2008. It was already dark when McKenzie began walking home from a friend’s house. A motorist failed to stop before turning right and struck McKenzie while she was walking across a marked crosswalk. McKenzie hit the windshield of the car, flew 20 feet in the air and landed on the asphalt. She sustained a large whole on the back of her head, torn meniscus, and large cuts on her knees, hips, elbows and many abrasions and bruises all over her body. She lost consciousness at the scene of the accident. Witnesses reported that the motorist didn’t even slow down for the red light or to check to see if anyone was crossing the street! The driver was cited as failing to yield to a pedestrian in a crosswalk.

As McKenzie’s Salt Lake personal injury attorney and friend, my heart goes out to her for the trauma and challenges she has had to face over the past year and a half due to the reckless driving of a motorist. She missed months of her senior year and endured several invasive procedures. In fact, McKenzie has just undergone her second knee surgery this year. McKenzie is a strong and patient young women and I believe she will recover from her injuries.

Liability Issues

The at-fault driver argued that since it was dark and that McKenzie was talking on the phone, it was not his fault for hitting her. He felt that she was the distracted one who should have seen his car coming. McKenzie couldn’t remember the accident since she sustained head trauma and loss of consciousness. Fortuneately, McKenzie’s parents had been quick to hire the services of Attorney Ken Christensen. Mr. Christensen acted immediately to preserve several key pieces of evidence and witness testimony that demonstrate that McKenzie was the victim and the motorist was clearly at fault.

Utah Cross Walk Laws

Utah law requires motorist to yield to the right-of-way to pedestrians walking in crosswalks. Utah Traffic Code states:

Section 41-6a-1002: The operator of a vehicle approaching school crosswalk shall come to a
complete stop at the school crosswalk if:

(a) A school speed limit sign has the warning lights operating; and
(b) The crosswalk is occupied by a person

Section 41-6a-1008: The operator of a vehicle crossing a sidewalk shall yield the right-of-way to
any pedestrian and all other traffic on the sidewalk.

For McKenzie, witness testimony further collaborated that the traffic light was red, and the pedestrian walk signal was on at the time of McKenzie’s accident. The at-fault driver failed to come to a complete stop at a red light before turning right and caused the tragic car verses automobile car crash!

Pedestrian Accident Statistics

Walkinginfo.org, a pedestrian and bicycle information and advocacy group, reports that 4,378 pedestrian deaths occurred in 2008 due to pedestrian verses automobile accidents. According to the National Highway Traffic Safety Administration (NHTSA), more than 64,000 pedestrians were injured and nearly 5,000 killed in auto accidents in 2005. Of that number, children under the age of 15 accounted for more than a quarter of these victims. The very nature of pedestrian accidents accounts for why they are so serious, and very often, fatal. Pedestrians and bike riders have very little if any protection in a collision. The automobiles that they collide with can weigh upwards of a ton and when you add the velocity at which the vehicles travel, it is easy to see why so many pedestrians die in serious accidents. If they are fortunate enough to survive a serious Salt Lake City pedestrian accident, their injuries can include broken bones, brain injuries, spine injuries, paralysis, and coma.

New Statistics Released: Fatalities on Utah Roads in 2009

2009 Statistics on Utah Traffic Deaths

On Tuesday January 19, 2010, the Utah Department of Transportation (UDOT) and Utah Highway Patrol (UTP) released their 2009 findings during a press conference for the Utah Zero Fatalities Campaign. Last year there were 245 Utah car accident fatalities on Utah highways. The Salt Lake Tribune reports that 2009 had the lowest number of Utah traffic deaths statistic since 1974. UDOT Executive Director John Njord attributed the decline of fatal car accidents to more motorists wearing their seat belts and the increased implementation of educational programs, including the Zero Fatalities Campaign, to high school students.

DUI Related Fatalities on the Rise in Utah

However, alcohol-related traffic fatalities Increased in 2009. Over the past few years, Utah has seen a rising trend with motorists drinking and driving. Just last week, State Senate majority leader Sheldon Killpack was arrested on a DUI charge. The UHP has increased their DUI blitzes and they are happy to report that there was not a single fatality on the New Years holiday of 2010 on Utah highways. A problem, voiced by the public and by tourists, is that Taxi services in Utah are quite limited. If often takes 30 minutes for a Taxi to arrive. In major cities across the country it only takes commuters a few minutes to catch a cab. Regardless, DUI driving in Utah is unacceptable. As experienced Utah personal injury attorneys, we have seen too many of our community members become victims of an alcohol-related car crash.

Cell Phone-Related Car Crashes Rising Trend in Utah

The increasing problem of cell phone use while driving was addressed several times during the conference on Tuesday. The Utah Highway Patrol and many transportation safety advocacy groups list cell phone use as one of the most distracting behaviors of motorists. Unlike many states, Utah does not have a ban on hand held cell phones.

Motorists who talk on their cell phones usually do not realize how much it impedes the quality of their driving. Inattentiveness at the wheel is especially dangerous. Studies show that a motorist talking on a hand held cell phone is just as distracted as one that drives with a blue tooth device. The results are the same: Distracted Driving Kills! While talking on cell phones, motorists tend to:

• drift off out of their lanes and hit other vehicles
• speed
• fail to use turning signals
• drive recklessly
• overreact -i.e. yanking steering wheel, overcorrecting and rolling their vehicle

Orem Woman Killed in Idaho Car Crash

Orem Woman killed in Idaho Car Accident

On Monday afternoon, January 18, 2010, Carlybeth Ramirez, 21, was killed in a car accident near Pocatello, Idaho. According to witnesses, Carlybeth lost control of her vehicle and rolled it several times. She died at the scene. Her passenger Tihare Salazar of Provo was taken to the hospital in critical condition.

My deepest sympathies go out to Carlybeth’s family for their tragic and heartbreaking loss. I offer my condolences to everyone who knew and loved this young woman. I also hope and pray that the seriously injured passenger, Tihare Salazar, will make a quick and complete recovery. The victims and their families will be in my prayers.

Traffic Accident Statistics

In November 2009, the National Highway Traffic Administration released the report titled Fatal Crashes involving Young Drivers which provides national statistics on the frequency of young drivers being involved in car accidents verses older and more experienced drivers. Some interesting facts are as follows:

• Youths and young adults ages 15-20 year old represent 19% of the fatalities in the
United States

• Of the passengers killed riding in vehicles with young drivers, 67% are in the same 15-20
year old age group as the drivers

• 56% of fatal crashes and 57% of the fatalities involving young drivers occur on rural
roadways

Accident Causes and Liability Issues

According to the initial investigation done by the Idaho Highway Patrol, it seems that Ms. Ramirez drifted outside her lane and when she tried to realign her vehicle with the road she overcorrected and lost control of her vehicle. However, it is not clear what caused Ms. Ramirez to lose control of her vehicle and whether she had indeed overcorrected her vehicle. We do not know if there was a mechanical malfunction in her car. Or if there was dangerous conditions or any debris left on the freeway that caused Ms. Ramirez to swerve out of her lane. Did another motorist’s negligence cause this tragic fatal car accident that claimed the life Utah woman?
The victims of this tragic accident would be wise to contact an experienced Utah personal Injury lawyer to ensure that a thorough investigation is conducted before evidence is lost and witness still have the accident details on their mind. The best personal injury law firms will always offer a free and comprehensive consultation to the victims and their families.

Utah Fatal DUI Car Accident on the Rise

Fatal DUI Car Accidents Increasing in Utah

The National Highway Traffic Safety Administration released their most recent findings from the research of all the 2008 traffic accidents and fatalities across the nation. The results: In 2008, an estimated 11,773 people died in drunk driving crashes involving a driver with an illegal BAC (.08 or greater). These deaths constitute 31.6 percent of the 37,261 total traffic fatalities in 2008. It is tragic that drunk driving has claimed so many innocent victims. After witnessing increased DUI arrests, Utah lawmakers and lobbyists have been taking a stricter stance on the subject. Unfortunately, one of Utah own advocates against drunk driving was arrested last Friday for driving under the influence of alcohol.

Utah Senator Resigns Following DUI Arrest

On Saturday, January 16, 2010, state Senate Majority leader Sheldon Killpack, R-Syracuse, resigned. He had been arrested for driving under the influence of alcohol the Friday evening before. This arrest came as a major shock to the community. During his career in the legislature, Senator Killpack was considered a hardliner against drunk driving in Utah. He had lost his own father to a drunk driver and has been passionately involved in the campaign to reduce alcohol related Utah car accidents. In fact, he worked closely with the President Art Brown of the Utah Chapter of MADD (Mothers against Drunk Driving) on legislation to toughen DUI laws.

Senator Killpack’s immediate resignation came as a surprise for the political community. For one, the Utah State Legislature will begin convening next week. Senator Killpack has been actively involved in several key committees and pieces of legislation. Now the Republican Party must find a replacement and fast. In a KSL interview, Dave Hansen, chairman of the Utah Republican Party, he stated, “It's gone from shocking to just unbelievable to very, very intense.” Many lawmakers and community members wonder what effects of the Senator “quitting” will have on 2010 legislative session. However, many people support the Senator resignation as further demonstrating his stance against Drunk Driving and breaking the law.

Fatal DUI Car Accidents In Utah

While Utah may be on the bottom of the total number of DUI related car crashes in the Nation, Utah does have an increasing drunk driving problem. According to the National Highway Traffic Safety Administration, Utah had an 81 percent increase in the number of alcohol-related traffic fatalities from 2003 to 2004 which is the largest percentage increase of any state in the nation. The following statistics, from Deseret News report on drunk driving accident in Utah, help to demonstrate this rising trend:

• In 2003, Utah had 36 alcohol related traffic accident deaths
• In 2004, Utah had 65 alcohol related traffic accident deaths
• Most recent statistics from NHTSA show that Utah had 50 DUI fatalities in 2008

Vernal Child Killed in Pedestrian verses Automobile Car Crash in Utah

Pedestrian verses Automobile Death

In a solemn report by the Salt Lake Tribune, 12-year old Ashley Lauren Maynard, passed away last Wednesday evening. On January 5, 2010, while waiting for her school bus, Ashley had stepped out into the street and was hit by an oncoming car. Ashley suffered from a traumatic brain injury and had been in the Primary Children Intensive Care Unit since this horrific Utah car accident. In a selfless decision, Ashley’s family has donated her organs.

My deepest sympathies go out to the victim’s family and friends for their loss. Ashley was an active and happy child who touched many during her short time with us. May thoughts and prayers are with those who loved Ashley as they go through devastating and difficult time.

Draper: The Most Dangerous City in Utah

Draper has the Highest Rate of Car Accident Fatalities

National traffic statistics routinely report that Utah is one of the relatively safest states in the country. In fact, Utah has the lowest rank of fatalities due to alcohol related car crashes nationwide. It is surprising then to discover that Draper, a beautiful suburb located near the Point of the Mountain, statistically is the most dangerous city in Utah.

Fatality Analysis Reporting System (FARS) released an in-depth report of the accident trends of each city in the State of Utah for the past twenty years. The report demonstrated that the State of Utah has pretty much consistently remained at 1.6-3.2 car accident fatalities per 100,000 persons. Draper on the other hand has seen a much higher increase in car accidents that resulted in deaths over the past decade. Draper had a record high rate of 9 deaths due to motor vehicle accidents per 100,000 persons in 2002. In 2003, Draper authorities reported 8 car accident fatalities per 100,000 persons while the nearby city of Sandy had only 2 fatalities that same year. During 2000-2003, Sandy City, a much larger and heavily populated city, did not have any fatalities caused by drunk drivers. National Highway Traffic Administration (NHTSA) reports that the number one cause of death between the ages of 2-30 are traffic accidents. The main causes of these tragic car accidents include:

• Distracted Driving
• Speeding
• Drunk Driving
• Driver Fatigue
• Inclement weather conditions
• Aggressive Driving

Why Draper Residents are Prone to be involved in a Utah Car Accident

Mounting concern for the safety of Draper residents is justified. Most car crashes involving personal injury occur 3-5 miles from your home. The number of deaths resulting from motor vehicle accidents undoubtedly has had a great affect on the tight knit communities of Draper City.

According to their research results, the National Highway Traffic Administration ( NHTSA) has provided a list of the main causes of motor vehicle accidents. Driving around Draper City one afternoon, it was plan to see that Draper residents are prone committing several of these mistakes that cause fatal car crashes in Utah.

Distracting Passengers Cause Fatal Accidents

9% of motorists who have been involved in a fatal car accident admit that their passengers had distracted them. In Draper, where 65% of the population is under 18, parents have the added responsibility of taking their children with them as they go about their daily lives. Children innocently cause the majority of these distractions. When one has multiple kids, the number of distractions and driving mishaps increases substantially! The common stereotype of the suburban housewife driving minivan filled with children while weaving in and out of traffic; tragically, has become an all too real phenomenon. A social phenomenon that has knowingly caused catastrophic accidents and personal injury. According to traffic authorities, when a driver is distracted he or she will increasingly drive erratically, speed, fail to yield and fail to properly use turning signals. Driving faster or slower than the flow of traffic has strongly been demonstrated to increase the likelihood and severity of crashes.

As a parent and a Utah personal injury attorney, I have been in the position of counseling families whose children have been victims of preventable car accidents. I know of almost nothing as tragic as having to deal with the challenge of losing a child due to a parent’s own distracted driving. Please remember these helpful guidelines when driving with passengers:

• Focus on the Road. Always. While your child may be frustrating, he or she is safer when
your attention remains on driving.
• Pull over in a calm and safe manner to address the issue at hand.
• Implement a reward system for kids who get fussy when driving.
• Don’t talk on your cell phone while driving. Increasingly, children compete for attention
when parents are talking on cell phones. This usually results in a child throwing a tantrum.
• Distract your child not yourself! Children love listening to music and reading while driving.

Is the Legislature Doing Enough to Reduce Drunk Driving in Utah?

Utah Drunk Driving Arrests on the Rise

According to national traffic safety experts, the daily death toll from drunk driving crashes during the Christmas and New Year’s holiday period is significantly more than during the rest of the year. A report presented to state legislators indicates that Utah has the lowest percentage of fatalities attributable to driving under the influence in the nation. The most recent statistics demonstrate that the United States average for traffic fatalities involving alcohol is 41%. In Utah, DUI accounts for 22% of road fatalities. However, the report indicates there is an upward trend in the number of arrests for driving under the influence in Utah. Last year, there was an increase of 639 arrests to a total of 15,300.

States taking Action to Stop Drunk Driving Accidents

Several states are taking additional action to reduce the number tragic deaths resulting from alcohol related traffic accidents. The State of New York recently passed legislation named “Leandra’s Law” which increases the punishment from a misdemeanor to a felony when a motorist drives under the influence of alcohol and/or drugs with passengers that are under the age of 16. The new legislation is named after a 11 year-old Leandra Rosado was killed on October 11, 2009, when her friend’s mother, who was driving drunk, rolled the vehicle Leandra was a passenger of.

NBC reports that more than 12,000 children under 14 died in alcohol-related traffic accidents between 1994 and 2000, according to a recent report of the National Highway Traffic Safety Administration. NHTSA found that in 64 percent of those deaths, the child was in the car with the drunken driver. Online polling after the NBC report demonstrated that 75% of New Yorkers were pleased with the new legislation on drunk driving which has caused other states’ legislatures to consider tightening their DUI laws as well.

Utah taking enough action to reduce DUIs?

In the 2009 during the Halloween blitz, the Salt Lake Tribune reports that there were 124 DUI related arrests made by the Utah Highway Patrol during that Saturday evening alone. UHP Sergeant estimates that there are typically 40 percent more drunk driving deaths when the holiday is on a weekend. UHP is pleased to report that there were no DUI crashes or fatalities this past Halloween; however, there were numerous drunk driving arrests made. Many of the arrests found minor is the possession of alcohol or parents driving drunk with their children in the back seat. This presents a social problem for Utahns. How do we stop drunk driving? It is safe to assume that we all agree that minors and alcohol should never mix. Zero Tolerance is already in effect in the state. If Utah implemented a felony punishment for those persons caught driving under the influence of alcohol and with children as passengers; would that help curb the number of DUI motorists on Utah roads?

An Experienced Wrongful Death Attorney Can Help

In cases where such negligence or wrong doing is involved, such as drunk driving, families of the deceased victim may file what is known as a wrongful death claim. An experienced Utah personal injury attorney can help you through this difficult time. In Utah a wrongful death case can be brought by the legal heirs of the person whom died as a result of the Utah accident. Only one single claim can be made on behalf of all heirs, but each of the heirs are entitled to a settlement. It is extremely beneficial to contact a Salt Lake City personal injury attorney specializing in fatal accident claims to ensure that the case is fully settled, so that legal heirs will not appear later to collect against the settlement. If you have lost a loved one in an accident, it is important to educate yourself before making any legal decisions. Orem Mother and 4 week-old Infant involved in Utah Rollover Car Accident

In the space of 6 months, Hailey was a victim of two different Utah car accidents. The first occurred when she was rear ended by a motorist who was texting. The second automobile accident was much worse. Hailey was t-boned by a teenager who was speeding across traffic lanes. The force of the impact caused Hailey’s Toyota Camry to roll 4 times. Hailey’s four week old infant was in the back seat. To make matters worse, Hailey’s husband was stationed in Iraq. Due to the nature of his deployment, Hailey was not guaranteed frequent contact with her husband. Hailey was on her own to make all the decisions surrounding her infant and her medical treatment and personal injury claims.

Hailey’s first impression of the insurance company was bad. Hailey’s baby girl was still in intensive care when Hailey was being pressured to purchase a new car within two to three days. She wasn’t clear about her policy coverage and she didn’t feel that she was getting straight answers from her insurance adjuster. Hailey needed help and fast. Hailey remembers feeling fearful that being a young mother and without her husband, personal injury lawyers and insurance adjusters may try to take advantage of her. She states, “I had been hit twice by negligent drivers in less than a year. The first law firm I worked with dropped my case because they were afraid it was going to be too difficult to handle both claims. During one of the most stressful times in my life, Kenny Christensen took both my cases and got excellent settlements for me. During the entire process, Mr. Christensen kept me updated and informed about my case. He made himself available to answer my questions and explain my legal options. I was treated like a person. I know that I made the right choice. I highly recommend The Christensen Law Firm.”

Hiring an Experienced Utah Personal Injury Attorney

Despite our attempts to be safe drivers, accidents still happen. Attorney Ken Christensen remembers Hailey’s plight very well. He states, “Hailey was wise to realized that it was not right for her be pressured by her former attorney to settle her first case prematurely.” Mr. Christensen is passionate about fighting for people who might be considered underdogs. If Hailey had listened to her former counsel and complied with their legal advice to drop the case; Hailey would have been in a far worse position. For one, she would be responsible for the additional medical bills she incurred as her personal injury protection benefits were exhausted quickly. The Christensen Law Firm, PLLC, was able to settle both of Hailey’s personal injury claims, made sure all her bills were paid and ensured that her property damage portion of her claim was resolved in a just manner. Large Trucks involved in Two Separate Utah Rollover Accidents Cause Personal Injury

Around three am on January 7, 2010, a semi-truck hauling 50,000 gallons of crude oil was involved in a single vehicle rollover right outside of Heber City on U.S. 40. The truck accident resulted in an oil spill that required the Utah High Patrol to stop westbound traffic until the Utah Health Department could send the hazardous material cleanup crew. Fortunately, nobody was injured in the trucking accident and the cleanup was completed in a couple of hours.

The second large truck accident this morning occurred on eastbound Interstate 80 when the driver of a dump truck lost control and rolled. The Deseret News reports that the driver sustained multiple injuries and was taken to a nearby hospital for treatment. Luckily, no other vehicles were involved and there were no other reported injuries. However, traffic was affected—during rush hour. Authorities are not sure why these truck drivers lost control of their vehicles and caused significant accidents on Utah roads. Investigators are looking into the possibility that the drivers were driving impaired by driver fatigue or inattentiveness. They have not ruled out whether the trucks mechanically malfunctioned.

Most people agree that they would rather have semi-truck operatives travel at night or early morning to avoid driving with the average commuters. However, some people are beginning to question whether the odd driving hours present a safety hazard. They wonder how successful long haul drivers are with coping with drowsy driving especially when traveling in the dark. Others question whether semi-truck operatives follow the speed limit during their long hauls.

National Statistics on Big Rig Accidents in Utah

Authorities report that large truck operators have several unique obstacles when driving across the country these include:

• Unfamiliarity with the roadway
• Driving too fast for conditions
• Maneuvering truck in a manner not designed for the weight or load
(which can off balance the entire truck and its load)
• Inattention
• Fatigue
• Illness
• Distraction by passengers
• Low visibility of smaller vehicles

Statistics from Fatality Analysis Reporting System (FARS) and the Motor Carrier Management Information System (MCMIS) report that an average of 5,000 large trucks are involved in fatal traffic accidents each year. Tractors pulling one semitrailer are the most common truck involved in a fatal trucking accident. MCMIS also reports that around 136,438 large trucks were involved in non-fatal crashes. From these statistics, it is obvious that motorists must be extra cautious when driving near semi-trucks and other large trucks. Even if a truck does not hit another vehicle, it can still be a lethal instrument. For instance, a trailer could jackknife across a highway, obscure other drivers’ sightlines, or push cars out of lanes.

The laws for dealing with the aftermath of truck accidents can get quite complex. Utah Rollover Car Accident Leaves Kearns Women Critically Injured

A Kearns woman is in critical condition after she lost control of her vehicle on Interstate 15 near St. George early in the morning of January 4, 2010. Witnesses stated that the woman hit the median, overcorrected and drove through all lanes of traffic before rolling her vehicle. Fortunately, no other cars were hit. Utah Highway Patrol Lieutenant Shawn Hinton confirmed that the two passengers in the woman’s car, a seventeen year old and a nine year old, are in good condition. The woman; however, sustained multiple serious injuries and was airlifted to Salt Lake City for emergency medical treatment.

It is unknown why the critically injured woman was driving erratically. Witnesses did not believe drugs or alcohol was involved. My heart goes out to the injured victims and their families. We hope they each make a speedy and full recovery.

Snowstorm Hits Salt Lake Valley Causing Hundreds of Car Accidents and One Fatality

On December 28, 2009, heavy snow fell over the Salt Lake Valley, making roads icy and especially dangerous. KSL reports that an astounding 208 automobile accidents resulted from the inclement weather and worsening driving conditions on that Tuesday alone on Utah roads. The Utah Highway Patrol confirmed that more than forty people were injured and that one woman was killed.

A twenty three year old woman had pulled her car to the side of the Interstate 80 in order to help the victims of a rollover accident. Utah Highway Patrol Sergeant Robert Breck, who responded to the scene, stated, "As one of the people stopped to help got out of her vehicle, another vehicle slid into the back of her vehicle, crushing her between his truck and her car." Tragically, in her courageous attempt to help another family, she was killed in a car accident. My thoughts and prayers go out to her and her family.

While it is still important to assist someone in need, there are safety precautions to take when responding to an accident or an emergency that will help to keep you safe. Following are a few emergency scene specific safety guidelines:

Enter the scene uphill/upward. This means that if you come across a motor vehicle accident, it is safer drive ahead of the accident and then pull over. This gives you an opportunity to scan the scene and look for hazardous material and any additional dangers.

Remain in the car. Stay in your vehicle until you are sure you are in a safe place. Check lanes of traffic. Assess the situation or accident from a distance before exiting your vehicle. Remember to turn on your emergency breaks to alert other drivers to slow down and even to help you.

Call 911. Calling the proper emergency authorities will ensure that medical help is on the way and the operator can give you immediate directions on what to do in your specific set of circumstances.

Remain Calm and Follow Directions. The 911 operator will assist you in how to approach the victims and accident scene. These emergency personnel have training in life saving techniques and can guide you through them if you are in a position to administer them to victims of an accident.

Wait for Law Enforcement. If you feel uncomfortable entering the scene, remain on the phone with the emergency personnel and remain where you have safely parked your vehicle. This way you can report if the situation changes.

2009 Utah Fatal Car Accident Statistics

Over the past several years, there has been a steady decline of fatalities on Utah roads. According to the Utah Department of Transportation, UDOT, there were 238 Utah traffic fatalities in 2009. This is down from a reported 276 fatalities in 2008 and 299 fatalities in 2007. Tragically, several hundred car accidents and three of the fatalities on Utah highways were caused by the two day snow storm that hit the Salt Lake Valley last week. While UDOT attributes this decline of car accident related deaths to increased driver education and the Utah Zero Fatalities campaign. However, authorities also stress that many of these motor vehicle accidents were preventable if drivers were more conscious of the weather conditions that affect Utah roads. This means slowing down when the road are wet or icy. Also, be sure to switch your vehicle’s tires to snow tires which are less susceptible to slipping or locking in Utah’s winter weather conditions.

Zero Fatalities reports that the major causes of Utah fatal car accidents in 2009 were:

Improper Restraint Despite the Utah Law which stipulates that Utah drivers must buckle up, many drivers continue to not wear their seat belts. Another common problem is that parents fail to properly install their child’s car seat.
Drowsy Driving Many drivers are unaware that drowsy driving is as dangerous as driving under the influence of alcohol or drugs.
Aggressive Driving It is important to drive in manner that is mindful of other drivers and pedestrians.
Distracted Driving Texting, music and talking while driving can take your attention off the road and increase your risk of being in an automobile accident.
Impaired Driving Driving under the influence of drugs and alcohol is a crime as well as a major cause of car accident deaths.

While it is good news to see the number of car accident fatalities is in decline, we think with increased diligence while driving, we can reach the initiative of Zero Fatalities in Utah.

Utah Car Accidents Caused By Distracted Drivers - Are You Protected?

Rainy weather, icy roads, sudden tire bursts—these are all dangerous threats to Utah commuters, as they can cause serious accidents. One of largest threats on our roadways, however, isn’t an outside factor like winter weather. It’s the driver. Distracted drivers are the cause of many Salt Lake City car accidents, some of which result in serious injuries or fatalities. In our fast-paced society, many commuters attempt to multi-task while driving by eating lunch on the go, putting on make-up, or taking a business call on their cell phone. Such behavior puts lives in danger.

According to KSL News, engineers at the University of Utah are trying to limit the number of distracted drivers. While lawmakers have attempted to do this by passing legislation, such as Utah’s texting and driving ban, these engineers are taking a less conventional route. Mechanical Engineering associate professor Mark Minors says that teams from all over the university are working on devices that can be attached to a vehicle’s interface and take control of certain aspects of the driving. Although he could not divulge much information at this time, Minors said that this new technology may be able to help prevent distracted driving. Similar technology is already in use in high-end cars. Radar devices in some cars are able to sense if the vehicle is approaching an object too quickly, and automatically apply the brakes if the driver is distracted and doesn’t notice the object. While technology is for automatic driving is still far away, recent technological advances are helping to reduce the threat of distracted driving.

Cell phone use is one of the most common types of driver distractions. According to a study at the University of Utah, using a cell phone (hand held or hands free) reduces a driver’s reaction time to that of a driver with a blood alcohol level of .08 percent, the legal limit. Furthermore, a study conducted by the National Highway Traffic Safety Administration found that drivers using cell phones are four times more likely to get into a crash. For more information on distracted driving and other Utah car accident statistics, visit the Christensen Law Firm’s online library.

One quarter of all accidents results from distracted drivers. If you have been in a Utah accident due to another driver’s negligence, you are entitled to receive full compensation for property damage, medical bills, lost wages, and other damages. Working through insurance papers and dealing with adjustors can be very cumbersome and time-consuming. Consider hiring Utah’s best personal injury lawyer, attorney Kenneth Christensen. Utah Accident Attorney Handling Accidents Caused By Text Messaging

At the Christensen Law Firm, we have represented several clients that were injured in car accidents caused by drivers that were texting while driving, including a husband and wife that were rear-ended at a high rate of speed on I-15 in a construction zone by a teenager that was texting. The Christensen Law Firm has posted several blogs and articles that examine the dangers of text-messaging and driving. In our library article “Intexticated," we analyzed research conducted by the Transport Research Laboratory, which found that the reaction time of a driver who is text messaging is reduced by a staggering 35%. As text messaging has become increasingly popular, more institutes have studied the dangerous effects of texting behind the wheel.

Some drivers might ignore the research and warnings of texting and driving. Text messaging has become an old hat for many people, as easy as typing or writing. As such, some commuters may think they are less likely to get in an accident if they text and drive. However, KSL News has reported on a recent study that found text messaging and driving is always dangerous, no matter how good you are at typing on the phone-pad. A panel of social media experts were placed on a driving simulator while they text-messaged. The results show that texting and driving is always a risky combination.

Fatal Car Accident in Summit County, Utah | Wrongful Death

Date: September 19, 2009
Location: US Highway 40 in Summit County
Type: Utah fatal car wreck, Utah car accident

A deadly car accident claimed the lives of a young engaged couple this weekend in Summit County. According to the Salt Lake Tribune, a 19-year-old woman had just dropped off her 2-year-old son at the baby sitter’s, and was driving to work with her 21-year-old fiancé. Near the interchange at Interstate 80, the vehicle swerved off the road, spun out, and crossed the median. The couple smashed into an eastbound Jeep Cherokee. Both the woman, who was seven month pregnant, and her fiancé were killed in the accident. The driver of the jeep, 66, and his son, 29, were taken to University Hospital with serious injuries. Troopers do not know why the vehicle spun out of control, but do not believe drugs or alcohol were factors. We extend our deepest sympathies to the family and friends of those involved in this tragic accident.

Utah accident victims must not only suffer through the difficulties of emotional and physical recovery, but endure the stress of working with insurance companies and dealing with complex legal papers. This can quickly become overwhelming, leaving the victim confused as to what to do next. This is why Kenneth Christensen, founder of the Christensen Law Firm, wrote the Utah accident book, "Seven Biggest Mistakes That Can Wreck Your Utah Car Accident.” In this book, Mr. Christensen breaks down complicated legal jargon into plain English, offering Utah accident victims a useful resource to help answer some of the questions they may have. Mr. Christensen discusses how to work with insurance adjustors, debunks common myths about accident cases, and helps explain whether or not you should seek legal counsel for your case. Salt Lake City Accident Caused By Text Messaging

Date: August 14, 2009
Location: 700 East and 550 South, Salt Lake City
Type: Text message accident, Salt Lake City car accident

Utah’s new texting and driving ban could be put to the test after a Utah car accident that occurred in downtown Salt Lake City this weekend. According to KSL News, a 49-year woman was driving her car erratically for blocks. Witnesses say she was text-messaging behind the wheel and was obviously distracted. Around 600 South, she suddenly changed lanes and crashed into a parked car. The crash caused her car to flip upside down. She was able to escape the car on her own with injuries. Thankfully, no one else was hurt in this accident, although there was significant property damage. Authorities are currently investigating the accident, and believe alcohol and text-messaging played a role in the accident. If text-messaging was a factor, this will be one of the first cases under the new texting and driving ban that came into effect in May.

Texting and driving is becoming a serious problem around the country. A recent texting and driving study conducted by Virginia Tech found that drivers who text are 23 times more likely to be involved in a car accident than drivers who do not. Consider the facts: studies have found that drivers who text-message face a reduced reaction time of 35%, which is almost double the 12% reduced reaction time of drunk drivers. Text-messaging is becoming the nation’s deadliest driving distraction. Please consider your own safety and that of your passengers and fellow commuters. Do not text and drive under any circumstances. For more information on texting and driving statistics, read the article “Texting and Driving is More Dangerous Than Drinking and Driving” in the Christensen Law Firm’s personal injury online library.

Fatal Utah Roll Over Accident Near Cedar City

Date: July 28, 2009

Location: State Road 144 in Washington County

Type: New Harmony fatal accident, Cedar City rollover

A blown tire led to the deaths of two commuters yesterday in a violent Utah traffic accident. According to the Salt Lake Tribune, an extended cab pickup truck was traveling eastbound on SR-144 near New Harmony. The vehicle blew a tire, and the driver lost control. The pickup swerved off of the left side of the road, rolled twice, and then flipped end-over-end. It then hit an embankment and became airborne, breaking into two pieces when it landed on the ground. Authorities believe the truck was traveling at high speeds when the tire blew. The driver of the truck, 38-year-old Jason McDonald, and 12-year-old Adaline Moore were killed in the wreck. The two other victims were transported to Valley View Medical Center in Cedar City. Authorities report that both have suffered critical injuries.

Did you know that rollover accidents are involved in only 3% of all traffic accidents, but account for nearly one quarter of passenger fatalities in Utah? Pickup trucks are more prone to rollovers that cars. Consider the statistics: 46% of fatal pickup truck accidents were due to rollovers. Many different factors can cause a vehicle to rollover, such as rough weather conditions, vehicle malfunction, or reckless driving. For more information on vehicle rollovers, read the article “Vehicle Rollover Crash Risks and Injuries” in the Christensen Law Firm’s online Utah Injury Library.

Date: July 18, 2009
Location: State Road 201
Type: Fatal Utah accident, Utah traffic accident

A tragic Utah traffic accident took place early Saturday morning that claimed the lives of six people, including four children. According to KSL News story “A Family of Crash Survivors Hopes for the Best,” a Mercury Sable was driving west on SR-201 around 1:00 a.m. and T-boned a Dodge Stratus. The Dodge was driving south on SR-202 and was attempting to make a left turn onto SR-201 at the time of the accident. Seven people were in the Stratus and only one survived, four-year-old Ricardo Ramiriez. At the time of the crash, he was sitting on the floor of the passenger seat beneath the dashboard. He was flown to Primary Children’s Medical Center in serious condition, but is expected to make a full recovery. Authorities identified the other victims as Veronica Martinez, 35, Ricardo Ramirez, 29, Mercedes Martinez, 15, Veronica Ramirez, 6, Isabel Ramirez, 5, and Megan Foote, 15.

The driver of the Sable, Jared Perry, was rushed to the hospital in critical condition, suffering from internal bleeding. His nine-year-old son was also taken to the hospital. He underwent surgery to have his back fused and had abdominal surgery to remove his colon and intestine. Perry and his son are expected to recover. Authorities are still investigating the accident and are not sure who is at fault. We extend our deepest condolences to the families and friends of the victims of this tragic Utah fatal accident. We wish Ricardo Ramiriez and the Perrys swift and healthy recoveries.

Car Accident Near Cedar City Turns Fatal

Date: July 12, 2009
Location: Interstate 15 outside Cedar City
Type: Utah fatal accident, Utah traffic accident

A devastating Utah fatal traffic accident occurred yesterday morning near Cedar City, leaving the southbound lanes of Interstate 15 closed for nearly seven hours. According to KSL News, a family of five from California was driving south on the freeway around 4 a.m. when the driver quickly swerved to avoid hitting a deer. He overcorrected the Range Rover, causing it to roll several times. It landed in the middle of the freeway. A few seconds later, the driver of a Toyota 4-Runner crashed into the Range Rover, unable to slow down in time. The driver of the Toyota was then able to move his vehicle into the emergency lane. Shortly after, a pickup truck collided with the Range Rover. Unfortunately, this major accident took its toll on the commuters involved. Two people in the Range Rover, Olegario Angulo and his 4-month old daughter Assata, were killed instantly during the rollover. Although Mr. Angulo was wearing a seatbelt, his daughter was not in a proper child car seat and was ejected from the SUV. The driver of the Range Rover suffered serious injuries and was taken to Valley View Medical Center in Cedar City. Two other passengers in that vehicle sustained injuries. Two people in the pickup truck suffered injuries and were flown to Intermountain Medical Center.

Deer can be an extremely dangerous safety hazard for Utah drivers, especially during the early morning and late evening hours of the day. Associated Content has a list of ten safety guidelines to prevent deadly Utah deer collisions; here are just a few of tips they mentioned. Bear in mind that if you see one deer near the road, there will likely be more. Drive with your high-beam headlights when you can to illuminate the eyes of the deer. This will give you more time to respond. Most importantly, do not swerve to avoid hitting the deer. Hitting a deer head-on is much safer than swerving and losing control of your vehicle. Damage to your front bumper and windshield is preferable to a serious and potentially fatal accident.

Davis County Cracking Down On Speeders

Davis County is continuing to ramp up its efforts to promote traffic safety. According to KSL News, the Utah Highway Patrol and 10 other police agencies are utilizing a federal grant to enforce speed limits. With the help of $150,000, authorities will take on 45 overtime shifts per month through this September. Police and troopers will increase enforcement on Interstate 15, business thoroughfares, and neighborhood roads throughout Davis County. Police regularly clock drivers at speeds exceeding 20 miles per hour above the limit. School zones and neighborhood roads are especially prone to speeders, as commuters are more likely to speed in areas in which they are familiar. Authorities believe that commuters are simply in a hurry and do not give themselves enough time to arrive at their destination on time. A similar speed enforcement program in Tooele County last year helped lower speeds in that area of the state and police hope that the same will happen in Davis County.

Speed plays a large factor in Utah traffic accidents. In 2007, speed was a contributing factor to 52% of Utah fatal traffic accidents. In addition, an average of 10,000 accidents occur statewide because of speeding. Please consider your own protection and the safety of your fellow commuters. Obey all posted speed limits, no matter the situation. If you have been injured in a Utah motor accident because of another driver’s speeding or negligence, you are entitled to receive full compensation for your injuries and other damages. Utah Car Accidents Could Cause Rupture in Breast Implants

We often equate Utah car accident injuries with broken bones, cuts, and bruises. However, we tend to overlook rare injuries that can be both painful and expensive. One such injury occurs to women who have had breast augmentation or reconstruction surgery. If a woman is in a car accident and receives a blow to the chest, her implants may rupture, causing potential health risks and expensive replacement surgery.

Breast implants consist of a silicone envelope with a saline or silicone gel filling. The design of the implant leaves it susceptible to potential tears or holes, causing it to deflate. When a saline implant ruptures, it leaks quickly out of the envelope and the body absorbs it. In some instances, this leak can lead to serious infection.

Silicone gel implants leak very slowly and can go unnoticed for years. The silicone may spread into other parts of the body, including lymph nodes under the arm and the lungs. If this happens, the silicone gel is impossible to remove. The FDA has reported that women with leaking silicone implants may suffer from fibromyalgia --a very painful disorder-- or other harmful diseases. Because of the potential health risks and the difficulty in detecting silicone gel leaks, it is important for women with silicone implants to schedule an MRI after a car accident.

It is essential to remove a ruptured implant as quickly as possible, a processes known as explantation. This process involves removing the implant in addition to some of the tissue and muscle in the surrounding area. Ruptured implants can usually be replaced with new ones, but this depends on the circumstances. Removing a ruptured silicone gel implant can be a difficult process, as the surgeon must ensure that the remaining gel does not spill into the body. A woman who needs to undergo explantation surgery should choose her surgeon wisely. She should pick a plastic surgeon who has substantial experience in removing implants. For more information on ruptured implants and subsequent surgeries, visit www.breastimplantinfo.org.

As you might guess, the cost of explantation surgery, follow-up visits with the surgeon, prescriptions, and other medical bills can quickly add up. Depending on the specifics of the procedure, an explantation surgery can cost anywhere from $8,000 to over $18,000. Insurance companies will try to find loopholes to avoid paying for the surgery, especially for women who received implants for augmentation rather than reconstruction. In both cases, the victim will need to prove that the implant was ruptured. This can easily be done through an MRI.

If you have suffered a ruptured implant due to a Utah car accident, you should not have to live with the consequences simply because the insurance company refuses to pay for the surgery. Implant leaks can lead to serious health complications that have debilitating effects on your life. Do not take the chances with insurance companies that will either refuse to pay the settlement or offer a lower payment than you deserve. Fiery Car v. Semi Truck Accident On I-80 Results in a Utah Wrongful Death

Date: June 13, 2009
Location: Interstate 80 near Tooele
Type: Fatal Utah accident, Utah wrongful death

A tragic accident occurred over the weekend on Interstate 80 near the border of Salt Lake and Tooele counties. According to the article entitled “UHP Locates Driver Wanted for Questioning in I-80 Wreck” from KSL News, a Dodge pickup truck was driving in the eastbound lanes around 11 a.m. Saturday afternoon. Apparently, a white pickup cut it off, causing the driver of the Dodge to lose control of the vehicle. The truck then went through an opening in the road barrier for emergency vehicles only and smashed head-on with a FedEx delivery semi truck. Both vehicles went up in flames. This left an especially dangerous scene, as the FedEx was transporting ammunition that randomly fired from the heat of the flames. The driver of the Dodge, Mark Neilson of Magna, died at the scene and the driver of the FedEx truck was critically injured.

The Utah Highway Patrol found the driver of the white truck that sparked this horrible chain of events. They say he is an elderly man from Salt Lake City. The man came in for questioning with his daughter and admitted to being near the scene of the crash, but claims he was cut off by another vehicle. UHP believes this man was driving the white pickup that cut off the Dodge pickup and did not stop at the scene of the accident. We will update this story when more news is released.

We wish the driver of the FedEx truck a healthy and quick recovery from his injuries and offer our deepest condolences to the friends and family of Mark Nielson.

Utah Highway Patrol Has Worked Overtime To Stop Speeding On I-80's Construction Zone

If you have driven on Intertate-80 in Salt Lake County within the last year, you likely noticed how difficult it is to navigate through the dense construction zone. You may also have noticed that many commuters dangerously speed along this patch of the freeway. This reckless driving was resulting in severe Utah traffic accidents, causing the Utah Department of Transportation to pay nearly $10,000 a month in overtime to the Utah Highway Patrol to catch commuters speeding between State Street and 1300 East. This increased effort began in March 2008 and has resulted in 3,000 ticket citations. At the beginning of the crackdown, the state found that drivers were averaging 72 mph in the 55 mph work zone. The overtime has paid off, as the crash rate has dropped by nearly one of half.

Reckless driving is always dangerous and this especially the case in work zones. Traffic is more prone to sudden slow-downs, leaving speeders with less time to brake. Lange shifts and merging also necessitate cautious driving. Furthermore, constructions zones have workers completely exposed to traffic. Speeding dangerously through work zones not only endangers other commuters, but these men and women as well. The I-80 construction will be completed later this year. Until then, please remember to drive cautiously and within the posted 55 mph speed limit.

Family In Minivan Seriously Injured in Redwood Road Accident

Date: June 3, 2009
Location: Redwood Road and 1660 South
Type: Utah car accident, Utah traffic collision

A serious Salt Lake City car accident left six people in the hospital yesterday morning. According to the Salt Lake Tribune, a minivan carrying a family of six attempted to make a left-hand turn onto northbound Redwood Road around 9:15 a.m. At the same time, a commercial dump truck was heading southbound and smashed into the minivan. A pickup truck driving behind the dump truck was unable to stop, lost control, and rolled over. A 14-year-old girl from the minivan was taken to Primary Children’s Medical Center via helicopter in critical condition. Three other passengers in the minivan were ambulanced to local hospitals. One person was in critical condition and the other two were in stable condition. The driver of the pickup and a man from the dump truck were also taken to the hospital in stable condition.

Now that the kids are out of school and the weather is finally warming up, you may be making plans for your long-awaited summer vacation. Before you jump in your car and hit the road, make sure you have your auto insurance in order by following a few simple guidelines. First, make sure you have your insurance identification card somewhere in your car. Your glove compartment or center console is a good place to store this. Also, make sure your identification card has the current phone number of your insurance company and agent. If not, go online and find those numbers and bring them along with you. If you are involved in an accident on your trip, it is good to have an idea of what to expect with your insurance company:

Utah Car Accidents and Spinal Cord Injuries

Traffic accidents can result in many serious injuries such as broken bones, traumatic brain injury, and head trauma. Damage done to the spinal cord can be an especially harmful injury with many long-term effects. The spinal cord consists of a large network of nerve tissue that is the core of the central nervous system. Damaging the spinal cord or vertebral column, the part of the body which protects the spinal cord, can be devastating for accident victims. Spinal cord injury can easily be incurred from Utah car accidents and it is helpful to know some basic information about such a substantial injury.

Damage to the nerves of the spinal cord can lead to permanent disability or paralysis. The location of the spinal cord injury often dictates the affects. Some injuries may lead to loss of mobility in the arms and legs known as quadriplegia or tetraplegia. Victims may also suffer paralysis of the lower half of their body, which is known as paraplegia.

Victims of spinal cord injury can suffer different severities of symptoms, depending on the damage incurred to the nerves. Complete spinal cord injury occurs when the spinal cord is severely damaged and usually leads to the total loss of feeling below the area of injury. Less severe damage can lead to partial spinal cord injury, in which the victim loses some, but not all, motor function and sensation below the injury.

Location: 3100 West and 5800 South Roy, UT
Type: Utah pedestrian crash, Wrongful death accident

A tragic Utah pedestrian accident took place in Roy, Utah Wednesday evening, claiming the life of a 54-year-old woman. According to KSL News, Wendy Kerbs was working in her garden with her husband when an SUV swerved off the road and struck her. Richard Bash, 40, was driving the vehicle. According to witnesses, he and another car were driving between 50 and 60 mph at the time of the accident. Neighbors say it appeared as if the two vehicles were racing. The other car fled the scene but Bash exited his vehicle and tried to break into some homes. Authorities believe he may have been trying to get away. Police arrested him a short time after the accident. As neighbors mourn the loss of Wendy, investigators are trying to figure out what the two vehicles were doing. No charges have been officially made, but officials believe alcohol may have been involved. Police are focusing on finding the second vehicle which left the scene. If you have any information, please contact your local police department.

Pedestrian accidents are a major problem in the United States. According to the National Highway Traffic Safety Administration, 4,784 pedestrians were killed in traffic accidents nationwide in 2006. Children are especially susceptible to pedestrian accidents. The University of Utah Health Sciences Center found that pedestrian accidents is one of the leading causes of unintentional deaths for children between the ages of 5 and 14. Utah Rollover Accident

Date: May 10, 2009
Location: State Road 38 in Box Elder County
Type: Utah vehicle rollover accident

The Salt Lake Tribune has reported a serious traffic accident that took place Sunday evening. A 34-year-old woman from Davis County was driving along State Road 38 when she rolled her SUV. Utah Highway Patrol indicated that the vehicle was driving southbound near Brigham City. The driver tried to pass four vehicles at once along the two-lane highway. As she attempted to pass, the wheels on the left side of her vehicle drove onto the dirt on the shoulder of the road. The driver overcorrected and sent the vehicle rolling four times. Unfortunately, the woman was ejected 80 feet from her vehicle as she was not wearing a seatbelt. A helicopter flew her to McKay-Dee Hospital in Ogden in critical condition. Authorities are investigating the accident to determine if impairment and excessive speed played a role. We wish the driver of this vehicle a safe and quick recovery from her serious injuries.

Did you know swerving and overcorrecting are two of the most lethal mistakes drivers make? In fact, 4% of all driving accidents each year are due to overcorrecting maneuvers. Police say 51-year-old Scott Slater was driving a Chevrolet Cobalt east on Pioneer Road and ran a red light at 2000 West around 9:00 pm. According to the National Highway Traffic Safety Administration, over 9,000 people died and another one million were injured in intersection-related crashes in 2005. Police say the driver was traveling too fast in the weather conditions and lost control of the vehicle, which slid into the median and flipped several times. The book is free to all Utah residents and addresses common myths associated with personal injury cases, such as:

• If you are in an accident, you always need an attorney.
• If you write the insurance company a nice, reasonable letter, you will receive a reasonable settlement offer.
• You cannot get a rental car unless you give a record statement,
• The insurance adjustor is being nice now; once I ask for a settlement he will continue to be nice.
• The insurance company for the person who hit you is obligated to pay your medical bills as they become due.

Utah Wildlife and Car Accidents

A recent article in the Salt Lake Tribune outlined some great advice for Utah drivers who have hit wildlife. Utah is home to all sorts of animal wildlife and each year 10,000 deer are killed by vehicles. Car accidents involving large animals can be very serious and most drivers do not know what to do if they are involved in this type of accident. If you crash into an animal, you may consider calling the Division of Wildlife Resources, especially if the animal is injured and suffering. You are not allowed to shoot or kill the animal, so contacting the DWR or police is a good idea. If the animal is critically wounded, an officer from the DWR or police will come out and euthanize the suffering wildlife. Collisions with large animals can do some significant damage to your vehicle, so you will want to contact your insurance provider right away. Usually, a report is not necessary. Simply turn in your claim like any other. If you strike an animal in winter and your car is inoperable, contact the police immediately. Remain in your car where it is warm and do not try venturing out in cold conditions.

Drivers and Passengers Sustain Head and Brain Injuries in Kaysville Truck Accident

KSL News reported a severe Utah truck accident that took place on February 21, 2009. The accident happened in Kaysville where a truck was driving southbound on Highway 89 around 2:00 am. The driver of the truck lost control due to icy conditions near Crescent Road and crossed into the northbound lanes. He smashed into another truck, causing it to roll over. Fortunately, everyone in the car wreck was wearing a seatbelt. However, three people were severely injured. Both drivers sustained head and back injuries and a passenger in the first vehicle was flown to University of Utah Hospital with head and internal injuries. Text Messaging is Just One Problem For Distracted Drivers

The Utah Legislature is currently debating different proposals to ban text-messaging for drivers. While a text-message ban will certainly reduce the amount of distracted driving, irresponsible drivers will still pose a threat to the roadways. A recent article from MSN News reported on astonishing statistics of distracted driving. GMAC Insurance conducted a survey of 5000 drivers across the United States. Amazingly, 8% of respondents admitted to changing their clothes while driving! In other surveys, respondents admitted to shaving their legs and applying makeup at the same time. Distracted driving is responsible for 25% of all accidents in the United States and it seems as if drivers continually find new ways of distracting themselves. One reported accident in California was caused by a driver doing bicep curls while in heavy traffic. Another accident in Canada was caused by a driver who was attempting to eat a bowl of cereal while behind the wheel. No matter the task involved, distracted driving is dangerous to the roads. The National Highway Traffic Safety Administration recently conducted a study, analyzing 42,300 hours of driving data. Researchers discovered that drivers are two to three times more likely to get in a crash if they are involved in multitasks such as applying makeup, shaving, or studying a map.

When making your daily commute, please consider your own safety and the safety of the drivers around you. Hang up your phone, put the makeup away, and focus on the road. We all have an important role in keeping our roads safe. For more information on distracted and “intexticated” driving, please visit our website’s library.

Salt Lake City Man Injured In Auto - Bike Accident

A Utah bicycle crash took place on February 15, 2009 in Salt Lake City. According to KSL news, a man was riding his bicycle along Holladay Boulevard through the intersection at 6200 South, when a woman turned left in front of the bicyclist, causing him to slam into her car. The bicyclist suffered injuries. Thankfully, he was wearing a helmet and did not sustain a serious brain injury. The driver of the car will be cited for failing to yield to a pedestrian.

The bicyclist would benefit from contacting an experienced Utah bicycle and pedestrian accident attorney to explain what car insurance policies he can make a claim under. Most people do not know they can make a claim under more than one insurance policy.

More and more people are using bicycles for commuting purposes. Drivers must always be attentive to bicyclists and pedestrians when driving and always yield the right-of-way. Left hand turns are especially hazardous as many drivers forget to watch for pedestrians before they turn. Statistics show that 23,000 hospital visits and 580,000 emergency room admissions are due to bicycle-related injuries each year. In 2007, 700 bicyclists were killed in accidents, 90% of which involved an automobile. As this crash demonstrated, helmets are a necessary safety precaution. Studies have found helmets prevent serious brain trauma in up to 88% of all crashes. For more information concerning pedestrian and bicycle injuries and accidents, visit our websites Library section. 3 People Injured (2 of them Pedestrians) in Box Elder County Car Accident

Three people were sent to the hospital Saturday afternoon, February 14, 2009 after two accidents on I-15 in Box Elder County, Utah. According to KSL.com, a red pick-up truck rear-ended a white Chevy Prism driven by a 22 year-old man from Layton, Utah. When both drivers pulled over and got out of their cars to exchange information, a silver car slid into them, sending them both to the hospital with serious injuries. The woman driving the silver car was also transported to the hospital.

As a personal injury lawyer I can easily say these type of accidents, where two accidents occur within a few minutes or days of each other, are the most difficult and frustrating claims for the parties invovled. This is because the insurance companies involved will always point the blame at the other car accident. That is why I wrote "7 Biggest Mistakes That Can Wreck Your Utah Accident Case." I encourage the two pedestrians involved in this accident to obtain a free copy of my book, they'll be grateful they did. In fact, a former Allstate Insurance adjustor said "noone should hire a lawyer or speak with an insurance adjustor until they've read this book." She had been growing her nails since 1979. At one point, she even turned down a $10,000 offer to trim her nails on Japanese TV. As of 2007, Redmond’s nails were 33 inches long! During the pile-up, she was ejected from her vehicle and broke her prized fingernails.

America's Most Dangerous Cars - Fatal Car Accident Statistics

A recent article from MSN discussed some of the safety hazards posed by smaller vehicles. As Americans are downsizing from SUVs into compact cars in an effort to improve gas mileage, questions are beginning to arise about the safety of smaller vehicles. While every automobile –whether car, truck, or SUV- undergoes stringent safety tests before being released, certain vehicles are safer than others. The Insurance Institute of Highway Safety recently released a report showing that some vehicles have a driver fatality rate of more than twice the average rate. At the same time, other vehicles have fatality rates that are significantly below the average. The study found 15 vehicles with low fatality rates of 25% of the national average. None of these 15 vehicles are small cars. In fact, the vehicle with lowest fatality rate is Chevrolet Astro van. Also on the list of safest vehicles are the Toyota 4Runner, Honda Odyssey, and Toyota Sienna. Of the 16 most dangerous vehicles, 11 were small cars and small trucks. Among the vehicles with the highest death rates were the Pontiac Sunfire, Dodge Neon, Kia Rio, and Acura RSX.

In essence, studies are finding that smaller vehicles, although more fuel-efficient, pose greater safety risks than larger SUVs and trucks. Before you purchase your next vehicle, consider visiting the websites for the National Highway Safety Institute and the Insurance Institute of Highway Safety for full crash-test reports. Fatal Car Accidents Declined in 2008

A recent survey conducted by the Governors Highway Safety Association found the traffic fatality rate has decreased substantially in 2008. 40 states and the District of Colombia indicated a decline in deaths on state roadways. The national average of fatality rates decline 10.7%. The survey also indicated that many states saw the fatality rate decline at a higher percentage rate than their decline in Vehicle Miles Traveled (VMT). Transit authorities take this to mean that several factors have led to the decrease in fatalities. Economic factors throughout the year such as high gas prices and the market’s recession have caused people to drive less. However, authorities believe other factors have contributed, including increased seat belt use, stronger state laws, and a reduction in drivers’ speed in attempts to improve gas mileage. Utah saw a 9% decrease in Utah fatal car accidents with 272 traffic deaths in 2008.

Please continue to drive safely. Always wear your seatbelt, properly secure your children, and always drive the speed limit. Let’s continue to decrease our fatality rate in Utah and our nation.

Utah Highway Patrol Warns Drivers of Speeding on Utah's Legacy Highway

Daily commuters rejoiced at the completion of Utah’s Legacy Parkway, a four-lane highway in Davis County which provides an alternate route from Interstate 15 for commuters. Traffic on I-15 has been reduced since Legacy Parkway’s completion. However, police are concerned that commuters on the new highway seem to have a knack for speeding. According to KSL News, many drivers are disregarding speed limits along Legacy Parkway. The speed limit along the highway is 55 mph. However, the Utah Department of Transportation estimates that commuters are driving an average of 10 mph over the speed limit. Utah Highway Patrol (UHP) worries that there are not enough troopers to properly regulate the highway. UHP has four troopers to patrol Davis County. I-15, Highway 89, and Legacy Parkway are all in their zone, leaving the troopers stretched thin.

Utah Residents Are in Favor of Law Banning Cell Phone Use While Driving

According to a poll conducted by the Salt Lake Tribune, 80% of Utahns are in favor of laws banning cell-phone use while driving. Still, many Utah motorists continue to talk on their cell phones while driving. Worse, many motorists text-message while behind the wheel, especially younger drivers. Yet 75% of men and 85% of women say they would support a cell-phone ban. Representative Phil Riesen is perhaps the strongest proponent of a legislative ban, proposing a bill that would ban just about all electronic communications for motorists, including text-messaging, email, and hands-free cell phones. His bill makes exceptions for emergency situations and two-way radios.

Research conducted at the University of Utah supports Rep. Riesen’s claims of the threats of motorist cell phone use. Researchers found that driving while on a cell phone is as dangerous as driving drunk. Test subjects were placed into a driving simulator. Those who were talking on the phone performed the same as those with blood-alcohol content of .08%. Furthermore, the same study found that hands-free cell phones are not any safer than handheld cell phones.

Although statistics and research show the dangers of driving while using a cell phone, Riesen’s legislation will likely meet opposition. Some legislatures argue that such a bill infringes on civil liberties, stating that laws already exist that punish distracted driving.

Rear-End Accident on I-15 Pushes Car 40 Feet Off the Highway

KSL News reported a serious Utah car accident on Interstate 15 in the early hours of January 15th, 2009. Around 1:15 a.m., a Ford SUV struck a Nissan car from behind, thrusting the car off the road near the Point of the Mountain. The car toppled down 40 feet of the embankment. The Utah Highway Patrol reported the Nissan was either driving slowly or stopped in the far-right lane when it was hit, possibly checking on an abandoned vehicle on the shoulder of the Interstate.

The northbound lanes on I-15 were closed for more than an hour as a medical helicopter landed to pick up the driver of the Nissan, who was flown to the hospital and remains in critical condition. The driver of the SUV sustained minor injuries. Our thoughts and concerns are with people involved in this accident and we wish them both a speedy recovery.

What Type and How Much Car Insurance Should I Have?

Erin Mahoney recently wrote an interesting article that took an in depth look at auto insurance policies and what type of coverage the average driver really needs. Auto insurance is a necessity for every driver, but insurance policies can be complicated to understand.

The insurance everyone is required to have is liability insurance, which provides coverage if you are at fault in a car accident. Utah residents are required by law to have liability insurance with minimums of $25,000 for single person bodily injury liability, $50,000 for all people bodily injury liability, and $15,000 for property damage liability.

Family Driving in a Minivan is Injured On Highway 6

Spanish Fork Canyon, known to be one of Utah’s most dangerous canyons, saw a serious car wreck on January 4, 2009 which shut down the canyon for several hours. According to KSL News, a minivan was slid out of control after hitting a patch of ice. The minivan slid sideways into oncoming traffic and was hit by a truck. Luckily, all the passengers in the van were wearing seatbelts. The driver was taken to the hospital in critical condition along with eight children from the minivan. One of the children is in critical condition. The driver of the truck was not hurt in the accident.

We wish this family and their child with serious injuries a full recovery. They will likely have extensive medical bills as a result of this accident, and although it appears that the parent driving the van may be responsible for driving too fast for conditions, Utah is a unique state in that Utah law allows family members to make injury claims against eachother. The family would benefit from contacting a Utah personal injury attorney to ensure the passengers' medical bills and damages are fully covered.

Ipods Are the Cause of Numerous Car Accidents

It seems as if every new technology brings with it a whole new set of dangers. Most people have been aware of the risks involved with cell phone use and driving for quite a while. Now, studies are showing iPods are also posing a similar threat to the road.

According to an article posted on physorg.com, recent studies have determined the effects of using an iPod while driving are similar to that of dialing a cell phone, which has proven to be a large hazard on the road. Studies have also found iPod use on the road is rather prevalent among drivers. In 2006, General Motors Acceptance Corporation (GMAC) conducted a poll which found 20% of drivers between the ages of 18 and 24 have selected songs from their iPod while driving.

Many Utah Car Accident Victims Refuse An Ambulance

KSL News reported that many Utah car accident victims are refusing to take the ambulance to the hospital after car accidents. Last year alone, about 2,600 people in the Salt Lake Valley declined an ambulance ride, instead driving themselves to medical care facilities. Authorities attribute this to the cost of ambulance trips, ranging between $800 and $1200.

While it seems common sense for someone suffering a few bumps and bruises to decline the ride, some people with traumatic injuries are opting out as well. Regardless of the seriousness of an injury, paramedics have no choice but to leave if a victim refuses an ambulance.

However, in Utah every automobile is required to have PIP Insurance which automatically has atleast $3,000 available for medical expenses resulting from a car accident, no matter who's at fault for the accident. Therefore, if emergency personnel feel you should be transported by ambulance, do not decline for fear of payment. Earlier this year a Utah woman refused life-flight transportation and instead took ground transportation by ambulance, but died on the way to the hospital. If she would have been transported by life-flight, she may still be alive today.

Computers and Driving are a Rising Problem On The Roads

We all know the hazards of distracted driving. We’ve been warned of the dangers of talking on the phone while driving, texting, eating, or putting on makeup. But one thing we have never been warned of is surfing the internet while driving. However, driving authorities may have to start a new dialogue of distracted driving that incorporates personal computer use as well.

It almost seems impossible to contemplate using a personal laptop while driving down the freeway, but it is happening more frequently these days. In the fast-paced world we live in, some people are using their laptops to check their personal and business email while driving. In 2006 alone, 510 drivers in California were charged by police for reckless driving while using a computer or video screen.

Spanish Fork is a wonderful place to raise a family, with a low crime rate, several city parks, and even an outdoor water park. Named after two Franciscan Friars who camped near the present-day city limits, Spanish Fork has grown into a robust city with a population of well over 20,000 residents.

Residents of the city enjoy a plethora of events throughout the year. For the past sixteen years, Spanish Fork has hosted a festival of lights for the holiday season. Each July, the city puts on the Fiesta Days Rodeo, attracting some of the country’s best rodeo riders. Every fall, residents participate in the Harvest Moon Hurrah. This fall arts festival includes musical performances, pony rides, local artists, and a giant straw bale maze.

Although Spanish Fork enjoys a low traffic flow, accidents still occur in this city, especially on Interstate 15. If you have ever been in an accident, then you know first hand how it can be an extremely confusing and frustrating time. Deciding whether to hire a lawyer and even choosing the right lawyer can also be difficult. Without a Traffic Signal SR 201 in Magna, Utah Will Continue To Be Dangerous

According to an article by Annie Cutler of ABC News, SR 201 at 80th West is still without a traffic light five months after Jennifer Hardwick was nearly killed at the intersection in Magna, Utah. This junction poses a hazardous threat to drivers and has been the location of many accidents. As winter rages on and driving becomes even more dangerous, citizens are pushing for a traffic light at the intersection.

Although UDOT has stated that there is enough traffic at this particular intersection for a four-way stop light, ABC reported that the legal discrepancies allow UDOT to drag its feet. UDOT can only be sued up to a certain monetary sum. Even if a case against the agency is worth several millions, they only have to pay up to $400,000.

Although it would only cost $250,000 to install a traffic light, this intersection is still without one. If you are driving along this route, please contact UDOT and encourage them to put the light in and in the meantime, please take extra precautions as you pass through this intersection.

Semi Truck Causes Accident in Salt Lake City

KSL reported a car accident the morning of December 11th, 2008. In what could have been an extremely serious crash, a car slammed into a semi-truck making a U-turn near Redwood Road and 3500 South. The driver of the car received minor injuries. Police stated that the truck-driver was making a completely legal U-turn. As of the time of the report, police were also investigating if the driver of the car had been drinking alcohol.

Many traffic accidents are the result of a vehicle making an illegal left-hand turn or U-turn. When you are about to perform a U- turn, always be sure you have plenty of room to do so and that oncoming traffic is at a safe distance. Also, don’t forget to check for perpendicular traffic making a right-hand turn into your desired lane.

Winter Weather Causes Numerous Accidents in Utah

The first snowfall of the year always causes problems on the roads, and this year was no different. Today, the early morning rain quickly turned to ice and snow, causing serious problems for Utah drivers. The Utah Highway Patrol responded to 30 weather-related accidents today in Weber, Salt Lake and Utah counties, combined.

The southern part of Weber county saw numerous accidents with Highway 84 having some of the most severe. Big and little Cottonwood Canyons' slick roads caused dozens of cars to slide off the road, with one ending upside down in the river.

With several big storms expected for this weekend, officers are asking people to drive slow and use extra caution to reduce your chances of being involved in a Utah car accident.

Redwood Road Accident Claims the Life of One and Injures Four Others

KSL reported a fatal accident on Redwood Road and 6200 South on December 5, 2008. One person died and four other victims were hospitalized after a car collided with another vehicle attempting to make a left hand turn. The deceased victim, a 64-year-old husband and father, was a passenger in the vehicle making the left-hand turn. His wife and daughter were also in the car, although they were taken to the hospital in stable condition. The accident is still under investigation.

Our condolences and deepest sympathies to the victims and families of this accident.

Left-hand turns are especially dangerous and often result in serious injury. The implementation of green arrows in traffic signals has helped reduce the amount of left-hand turn accidents. However, not all traffic lights have a green arrow, leaving a great deal of responsibility and awareness on the driver. Unsafe left-hand turns are against the law and the operator of the vehicle will be held responsible for damages.

Crash Taxes: Make Sure Your City Doesn't Have Them!

One of the most frustrating aspects of a traffic accident is dealing with the bills. Insurance will usually cover a large portion of medical and car repair costs, but who pays for the emergency response?

According to an article on MSN Money, you do. Well, if your local police and ambulance departments get their way. Currently in Utah there is no fee for having a police officer called out to the scene of a an accident, but some cities in the United States have started sending bills to the accident victims for their services. This has been referred to as “Crash Tax.” The problem is that most insurance companies refuse to cover these expenses, claiming it is not their responsibility and that the accountability should be placed on local taxpayers.

A handful of states have banned these “crash taxes,” but Utah still has not. Currently, any city in Utah can pass an ordinance allowing their fire and police departments to bill the Utah car accident victims for having to respond to the scene of an accident.

Holiday Travel Statistics Are Shocking

According to the National Highway Traffic Safety Administration, approximately 4,020 people in the United States die from car accidents between Thanksgiving and New Years Day each year. Most of the fatal accidents are caused by driver fatigue, speeding and cell phone use. Studies show that a large amount of the accidents involve college students who are traveling home for the holidays.

According to Mothers Against Drunk Driving an estimated 1,000 people die during the period from Thanksgiving to New Year’s Eve in drinking-related crashes. The Insurance Institute for Highway Safety reports that most deaths involving alcohol-related car accidents occur on December 23rd and January 1st. Fatal car accidents are devastating no matter what the surrounding circumstances are. But when a drunk driver gets behind the wheel of a car and causes a preventable injury or death to someone else, the situation is even more tragic.

Improper Left-Hand Turn On Bangerter Highway Sends Two People To The Hospital

A car made a left hand turn in front of a white van on Bangerter Highway, Wednesday evening November 5, 2008. According to a KSL report, "Serious Accident Sends 2 To The Hospital," the white van approached the intersection when the car made the improper left hand turn. The van struck the car, rolled on its side and then skidded into a light pole. The passenger in the van was trapped in the van until emergency vehicles were able to get him out. He was transported by helicopter to the hospital. The driver was also taken to the hospital by ambulance.

A large amount serious Utah car accidents are caused by someone making an unsafe left-hand turn. Utah law, however, states that left hand turns are improperly made when an oncoming vehicle is so close as to present an immediate hazard.

If you are injured in a Utah car accident due to a driver's failure to keep a proper lookout before making a left-hand turn, you would be well advised to contact a Utah Personal Injury Lawyer in order to know your rights before speaking with the negligent driver's insurance company.

School Bus Driver Seriously Injured When the Bus Collides With a Car and Semi Truck Near Gunnison, Utah

A Head Start bus transpoting children to school just north of Gunnison on SR 28 in Sanpete County collided with a car and semi truck Tuesday morning October 28, 2008 according to a KUTV report.

A man driving a Ford Taurus made a U-turn and collided with the school bus, causing the bus to lose control, enter oncomming traffic and hit a semi truck traveling the opposite direction.

Five children were in the bus at the time of the accident and were transported to the local hospital. Fortunately, the bus had seat belts for the children, so their injuries were not fatal. The bus driver sustained the most serious injuries and was taken by ambulance to Gunnison Valley Hospital.

We wish the children and this bus driver a full recovery. It appears the bus driver will have extensive medical bills and even lost wages following this accident. Although, the driver was working and qualifies for workers compensation coverage, additional claims are available.

What most people do not know is that although Workers Compensation will likely cover the medical bills and lost wages, the bus driver can make a personal injury claim since this accident was caused by the negligent driver of the Ford Taurus. Personal injury claims are typically better than workers compensation claims as they allow for full recovery of damages compared to a small percentage under workers compensation. Since this accident was the result of another party’s negligence, this victim would be well served to consult a Utah Personal Injury Attorney or obtain a free copy of my book "7 Biggest Mistakes That Can Wreck Your Utah Accident Case."

Jordan River Parkway runs through Lehi City, offering a nice scenic path for bikers, walkers and joggers.

Lehi has also seen numerous car and truck accidents. In the wintertime, Interstate 15 near the point of the mountain between Salt Lake and Utah counties can have some of the worst road and visibility conditions during a Utah weather storm. Centerville Girl Seriously Injured In a Hit-And-Run Accident

Amelia was unconscious and suffered a broken arm, concussion and bruises. Police are looking for a light grey or green colored minivan. The van may have front end damage to its bumper. If anyone witnessed this accident or has seen a matching minivan, please contact police.

I offer my condolences to Amelia Cordova and her family and hope the community can help find the person responsible for this sad accident.

Sadly, 100,000 pedestrians are injured each year and half of those injuries result in death. Even worse, many of these accidents are caused by a driver's inattentiveness and the driver leaves the scene and can't be found.

After a Utah hit-and-run accident, victims are left with expensive medical bills and serious injuries and don't know what to do. Fortunately, if you are involved in a Utah hit-and-run accident and have proof that the accident was caused by the negligence of another, you can make a claim for both medical bills, pain and suffering, and other damages under your household's own automobile insurance policy.

Murray City Accident Attorneys and Personal Injury Lawyers

Murray City, centrally located between Midvale City and Holladay, in the Salt Lake Valley, is one of the oldest cities in Utah and it boasts of its exciting beginnings. In 1902, after a riot and fire was started by a group of smelter workers in a local saloon, a local newspaper editor began the fight for city incorporation with the vision to bring more order and community involvement in city planning and maintenance. Today, Murray City has surpassed this goal and provides for most of its own services including police, fire, power, water, and sewer. Community activism remains strong through the social networking with in the city government, library events, volunteer committees, senior centers, parks and recreation departments.

Car accidents are a daily occurrence in Murray. State Street, I-15 and Highland Drive all run through Murray and have seen some of the worst accidents in the entire state.
